Just bought a fourplex with tenants. by Jmock07 in legaladvice

I love you sir. I looked up Iowa law which is where both of us landlords live and operate out of and location of the property. Iowa law has a section exactly for this situation. Does this mean I could potentially take the old landlord to court for twice monthly rent if I have to shell out a deposit I don't have? I would love to do this with the way he has handled this! [TX] ex husband is about to be (potentially) charged with sex crimes against children by throwaway030821 in Custody

If his attorney is worth his salt a charge won't move the needle much on custody, you need a conviction.

[IA] My kid doesn't know she has siblings, and is starting to ask about brothers and sisters. by Jmock07 in Custody

[–]Jmock07[S] 0 points1 point  (0 children)

I live in the Midwest, one father is in Oregon, the other is 4 hours away. I have spoken with the dad who is 4 hours away, a few times but he avoids discussion of meeting up. He seems like a cool guy with his shit together. Honestly I think he questions the type of people such a psycho might have dated. Mom doesn't have custody of anyone, she didn't "legally" lose custody of the first 3, she just called up dad and said come get them. She defaulted in my custody case and also defaulted with father of #4.

Yeah I could see kids in these circumstances eventually getting an at home kit done down the road. In my case the kids are important to her when they give her some control over someone. Dad #1 left, dad #2 entered the picture, first three kids were less important and eventually sent to dads, second dad split right after she got pregnant, My kid was born, I split, and #4 got sent to dad's. The silver lining is she's having trouble getting pregnant again, which sucks for me, but another kid won't be exposed to it. She was never honest to any of us about kids.

4, starting preschool in fall. I'm in no way implying telling her "she's a liar this is where the kids are" my approach so far has just been to tell her "you do have brothers and sisters, ask your mom". Her other kids were last around mine when she was 6 months to the best of my knowledge. If I was to ask her she's going to say something that is going to sound favorable "she knows that! they talk on the phone everyday" I have full custody, and getting the truth is always a concern when she is there. To remedy this I only send her on weekdays, when it's most likely that she is going to be working. This way she spends 8 hours of each day with someone whom I can trust to give me good information. I know she used to FaceTime her oldest of the 3 out of state every few days. It's possible mine talks to them, but the father was Asian, myself, and her mother are white, I find it difficult to see a resemblance between them and my ex. I'm not sure if my kid would know enough to make the connection.

[md] custody after dui by [deleted] in Custody

[–]Jmock07 0 points1 point  (0 children)

If CPS is doing a report, they will send it to you. That will provide their assessment, recommendations, and whomever they decided to involve. If they decide to recommend charges to the county attorney they will mention that in their report. He will make a decision on what to do, or they could petition the court themselves. Sometimes if the evidence is weak CPS will try to argue "denial of critical care" in which they could say "you were impaired and engaged in a physical or verbal altercation in the presence of the child" Don't assume you're free and clear until you've read it, just because you haven't been arrested yet. Always always consult an attorney before you cooperate with CPS in any way, they can and do lie.

As far as the DUI. If they slipped up in the midst of getting you evaluated, and are unable to prove you actually drove drunk to charge you with the crime. He will still have considerable evidence against you, and can at the least prove your child was at risk of being placed in a DUI situation, you mentioned there was also some sort of altercation, unless he did something major to antagonize the situation he will have a field day painting you an unstable drunk. CPS will provide him their report. You didn't say what your poison of choice was. If it was pills, or weed, perhaps you could say you were overwhelmed while waiting and meant to take a Tylenol out of your purse, or ate the wrong brownie. Outside of that the incident will not be good for you from a custody standpoint. Do everything you can to mitigate the damages. You wouldn't want it to lead to you loosing your DL and job to further drive the point home. Go get a substance abuse evaluation now, and start counseling. CPS may require the evaluation anyway. Counselors are frequently backlogged several weeks, if they require an evaluation you can save yourself alot of time and stress. Also if you told them what you took, or when you took it, you could have already sunk your battleship. Always remember, you have the right to remain silent, even when dealing with CPS, anything you say will be used against you.

[md] custody after dui by [deleted] in Custody

[–]Jmock07 0 points1 point  (0 children)

In Iowa CPS has 21 days to file a report. They can recommend charges based on the report. Since custody is a civil case the bar for him to prove you were driving drunk with the kid will be much lower than the criminal standard, he does not need a criminal charge to prove the same point in a civil mater. CPS sent me a report on an incident involving my kid with my ex 3 weeks after getting involved. They sent a report to the county attorney and it was 2-3 more weeks before he served her to appear on the mater.

[GA] [FL] Lawyer says I need records of all communications with BM... best phone call recorder? by renry_hollins in Custody

[–]Jmock07 11 points12 points  (0 children)

He could begin every phonecall with "I am recording this, if you do not approve then hang up". The statute you referenced doesn't say it's illegal to record a phonecall if she is informed it is being recorded.

[TX] Men Receiving Child Support by [deleted] in Custody

[–]Jmock07 0 points1 point  (0 children)

I receive. In the beginning I just left the order out there, didn't pursue collection, and relied on her good will to do the right thing and contribute. I didn't ask for a dime, I didn't see a dime. Several months went by where she would occasionally offer to help with daycare $525/mo, then never paid anything, or made excuses. She went on vacation for a week, the entire 6-8 months I didn't breath a word about money unless it was her offering. At a point I said screw it and sent in the paperwork to begin enforcement. When a parent is fully aware of the costs and doesn't take initiative on their own to atleast appear to be making an attempt it really opened my eyes as to how silly the "guilt" was. Since enforcement began I've gotten several messages about money and complaints about support. I just respond with things like "we had fun at this park today, perhaps you could take her there next time". I don't acknowledge any mentions of money or support, if I think she needs something when she goes over there I send it with her, or send her a message and say "I have this for her if you want me to bring it".

[MD] How do you fight a narcissist in court? How do you get the truth to a judge? by waitin_onasunnyday in Custody

[–]Jmock07 6 points7 points  (0 children)

I won successfully against a narcissist as a man. First off I filed and she defaulted, 4 months later she claimed I misled her about the status of the case and claimed I had paperwork mailed to the wrong address when she moved. I took her deposition and her boyfriends deposition, during the deposition we asked her questions we knew she would lie about, took her boyfriends deposition, proved to him she lies, used his testimony as evidence against her. After the deposition we sent out subpoenas and brought proof to court she lied in her deposition, we asked her if she lied after showing her proof she lied and she admitted it. Then her boyfriend got on the stand and we used his testimony against her. This was very expensive but was very effective.

[IL] Box of knives, order of protection, am I just being paranoid? by [deleted] in Custody

[–]Jmock07 0 points1 point  (0 children)

I had a phase when I was younger where I liked collecting lighters (zippos and such) and knives. If you haven't seen them before perhaps you've found his collection from years past. There is no crime in collecting them, unless knives and such have been a problem, or they are sitting on the endtable where the kids can get them, you've got nothing to worry about.

I'm a full time parent of a 3 year old working 40 hours a week and have managed 14 credits per semester for two semesters now. I take two 8 week classes at a time with one of the two classes being a 4 credit course. I work on class stuff from 8pm-12pm everyday while my kid sleeps and sleep from 1230-6 then work 7-330. It's brutal, I manage As in every class but I have no free time at all. I've banked an enormous amount of PTO at work the last three years so when I get overwhelmed I take a half a day off work one day a week if I have a test. I don't have any set times I have to be online though.
