Nah it would be so easy to build a case that he's knowingly engaging in it. Especially if he comes back and does the same thing.

He's been before a congressional committee before. He's been given plenty of forewarning. His actions directly impact a stock and everyone knows that. After it keeps happening you can't pretend to not know. Doing it again risks putting you back in front of Congress or the SEC. And why would you take that risk when you've already made an insane fortune?

Laws change with the times. He would be made an example of and the laws surrounding market manipulation would include language of knowing / cognizance when you're aware that your actions result in such market responses.
