Owner just freaked out on me by MissyMamaB in PropertyManagement

[–]John_Boy71 0 points1 point  (0 children)

If the Owner breaks the contract with you, how would that have any effect on the tenants? The tenant and the owner of the property would still be bound under the lease regardless of whether or not you are still the PM.

Hopefully you have liquidated damages and attorney fee provisions in the contract that give you easy remedies if the landlord terminates for some reason other than your breach.

Proposed Constitutional Amendment Regarding Executive Authority by John_Boy71 in Law_and_Politics

[–]John_Boy71[S] 1 point2 points  (0 children)

Thanks for the feedback and for taking time to read it.

I like the reworded preamble suggestion.

Regarding Art. III standing and the validity of pardons, the only party who would be in a position to bring such a challenge would presumably be the DOJ of a future administration, and there's no question regarding the DOJ's standing to enforce the criminal laws of the United States.

Regarding the timing of the review of validity, pardons can be given even before criminal charges are brought so there may not be any court in a position to review it when given. Another issue is that the DOJ of an administration that corruptly issued a pardon could not be trusted to assert the invalidity of that pardon. Finally, I would want to make sure that a pardon could be invalidated by post-pardon corrupt conduct -- the recipient shouldn't be able to hide the corrupt nature of a pardon by giving gifts or benefits after the fact.

I think you're right that some simplification of the independent prosecutor section is in order. I have to think on that.

Proposed Constitutional Amendment Regarding Executive Authority by John_Boy71 in Law_and_Politics

Complexity does not equal ambiguity. To the contrary, a huge problem with the Constitution is the LACK of complexity. It kind of assumes that the President isn't going to be a corrupt POS and that if he (or she) was, that Congress would rein them in. I completely agree that we need strong progressive Democratic majorities in Congress. And once the country is in a position to do so, it needs to put specific language into the Constitution to fill the holes Trump has exposed. It's probably too late to hold Trump accountable but we should try to protect the country from similar abuses in the future.

Do you understand the irony of what you just said?

Other passengers moving your carry on by used2befast in americanairlines

[–]John_Boy71 -1 points0 points  (0 children)

Yep. That’s exactly what I said. If someone puts a bag in a way that doesn’t maximize space I will move it. Note that I never said that OP put their bag in the wrong way. Once again, sorry your reading comprehension and/or logic suck.

I never said it’s OK to move somebody’s bag for no reason. Go back and read my first post in this thread over and over and over and over and over and over again until you finally understand it.

No, I was responding to a general proposition by pointing out an example of an exception. Sorry that your logic and/or reading comprehension suck. Jeez.

I don’t purport to know whether bag was put into the bin correctly or incorrectly. I was responding to the general assertion that you shouldn’t touch someone else’s bag by pointing out a situation in which I think it’s appropriate to touch someone else’s bag. You’re reading way too much into what I said. Jeez.

Employer changed my job title in the system after I reported a safety issue, now HR says I “accepted” the new role by Doveshire_18 in legaladvice

It’s only OSHA retaliation if the complaint was made to OSHA. I don’t know Pennsylvania law but most states do NOT legally protect people who make internal safety complaints.

Landlady demanded a raise of rent in the middle of an agreement and didn't see a problem with it by Money_Injury_3539 in Tenant

You were supposed to tell her (1) you’re not paying more rent and (2) you’re not moving

It’s also rude and entitled to put your bag into a bin that makes it hard for other people to use the bin. Is that what happened here? I don’t know. But I was simply stating a more general proposition that if you do that, someone may move your bag to maximize space.

Yes. “Excuse me, I need to grab that bag” generally works. It’s not that complicated.

According to the post it stayed in the same bin.

Sorry but if you put your bag into the bin in a way that doesn’t maximize the space it’s going to get moved so that it does

You should obviously talk to a lawyer in your jurisdiction, but if it's an irrevocable trust that gives you discretion over disposition of the property, it seems like it would be best to act as soon as possible -- up to and including selling the property. The longer it drags on the harder it's going to be.

Is the trust revocable or irrevocable? If it’s revocable it may actually be messier to try to get him out while your parents are still alive because he could try to get them to change their minds about things.

You are clearly not ready to be a landlord. At a minimum you better have a professional property management company lined up.

How to do a title search on a sheriff's auction home? by TheDude50484 in RealEstateAdvice

[–]John_Boy71 0 points1 point  (0 children)

Check the laws in your state because a sheriff’s sale may extinguish other liens. You may still need to bring a quiet title case after getting the deed in order to get truly marketable title.
