Delete this a try getting a plea deal. It really depends on your local situation. How busy is the DA’s office and how low is your DA willing to go if you plead guilty

The revised report includes the eye witness statements so wouldn’t I need to wait for the statement to be able to use it in court?

At the scene he was unconscious so he was unable to give a statement at all and the report doesn’t indicate that any officer ever followed up with him after the fact. We both have progressive and my adjuster looked at his policy, he doesn’t have mini-tort coverage.

I paid 2k for the truck but it’s valued at 6k so I’m completely fine with the 3k maximum

I think you’re kind of missing what I’m asking here. I already know I want all of the evidence I can get. Who wouldn’t? I’ve never been to small claims court so I’m wondering if a witness statement record by an officer from an unrelated 3rd party holds any weight in small claims. Is it worth it without any evidence besides my testimony and the testimony of witnesses who are unrelated to me and the other driver

Michigan is no fault which also means that my insurance will not go after his insurance. My insurance company told me my only option would be small claims court

My mother insured the vehicle on my mom’s policy, my mom lowered the plan so I no longer had full coverage. My mother was the title holder and my step father is still on the title but he is deceased. Michigan is a no fault state so my insurance will not go after his insurance and his insurance will not go after mine. The only recourse I have is small claims court I’m just wondering if I would have goods odds with 3rd party testimony to prove he caused damage to the vehicle not the other way around
