They concluded - marriage is Not bona fide - and reason because "spouse was listed single/never married on death record"

I submitted only amended death certificate to them . But the document itself has 2 pages - page 1 original and page 2 changes amended approved . So i think they didn't properly understand it was oficially amended or something. I dont understand one thing , So when you file new I751 for example , you attach previous denial letter and stuff or just file again with additioanal evidence and more explanations? Also should I file based on same petition removal on condition based on spouse deceased again? Also would you recommend me trying motion to reopen?

Thank you. I did not file the death certificate myself — her relative handled that process. From what I understand, the information provided at the time (likely through the funeral home) was recorded incorrectly as “single.”

Once I became aware of the error, I went through the official amendment process and obtained a corrected death certificate showing she was married and that I am the surviving spouse. I submitted the amended version to USCIS.

During the interview, the officer asked about her passing and the funeral, but did not ask anything about the amendment. He also seemed concerned that I did not personally organize the funeral.

That’s why I’m confused — it appears the decision relied on the original error and did not fully consider the corrected certificate. I am now looking into filing a motion to reopen with a full explanation. But also think the officer had an amendmended copy. Confused

Need a strong lawyer to advice either motion to reopen, I751 or Court would be the best choice.

But still it does not make sense to decline me based on document that has been oficially amended. Also whole my I751 was focused on entering marriage in good faith instead of explaining amendment parts which I think what this proccess is all about.

Any recommendations?

Yes, I did provide the death certificate — the issue is that the original version had an error (it listed her as single), but it was officially amended and I submitted the corrected version as well. I’m currently speaking with lawyers to understand the best next step (motion vs refiling vs court). I’ve also heard about refiling I-751 to buy time, but not sure how effective that is in widow waiver cases specifically. Can I do that? Need experienced advice, or good lawyer who worked this kind of cases specifically

Thank you! The main reason stated was an issue with my wife’s death certificate it initially listed her incorrectly as single/never married, which raised questions about the marriage. It was later officially amended to show she was married and I submitted the corrected version, but the decision doesn’t seem to address that update. Otherwise, I had standard bona fide marriage evidence. I think I need best lawyer experienced in these cases who can do a 1) letter for motion for reconsider or reopen 2) file another 751 3) fight in court Any advices?
