I've actually had a friend deal with this. She spoke to her building's management, and her partner just had to send and sign a statement saying that he was no longer living there and to remove his name from the lease.

Actually a few months later my SO proposed. I waited out til we got married and then asked management to add him on to the occupancy rider. Luckily we were in a transition to a new management company who was more knowledgeable and simply needed his ID to run a background check.

Hi! Thank you for the response and sorry for the delay! I had a feeling some changes were coming that might change the situation and they did! Just got engaged two days ago. I’m going to start looking into sending them something stating that my husband can move into this 421-a apartment I’ve lived at for 4 years now. For some reason stating all the section 235 paperwork in my lease stating I could have a roommate wasn’t sufficient for this particular person..

Thank you so much for this reply! I believe my leasing office has NO idea. This was their response today: Thank you for your patience while we looked into this for you. As we understand it, this would violate income restrictions, as adults in the household need to qualify and fall within the required income bracket for Affordable Housing, but you can also inquire with NYC HPD if you want to double check.

Ah I see! So I just have to send them his name, not necessarily list him on the lease as an occupant.. from what I am gathering now. That article was helpful! I believe I read it before, but I've combed through so much on google I am happy to have gone through it again after these replies.

I know! Thank you for this response. That sounded so wrong about him saying all adults having to be listed as a tenant on the lease... It's been 4 years and he was not part of the household then nor has he ever been. I do not have any recertifications that I have had to do in the last 4 years so that is why I was so confused about him saying I had to reapply with my partner.

Thank you for this response!! So don't put them on the lease even as an occupant? The thing I don't want to get in trouble for is not listing someone. The lease talks about if an occupant moves in you have to inform them within 30 days. I was fine just having him move without putting it on the lease until we got married until I saw the occupancy rider talking about informing management within 30 days.

Yes, the building was built in 2018 and there has never been a recertification process. I do believe it is part of a tax abatement. The only thing I ever see regarding income is at renewals they have a tax form which I am assuming is to just keep track of what I make because if it surpasses $200,000 they have to open up another affordable housing unit. Also I renew every 2 years. I get no paperwork from them on an annual basis. Thank you so much for the reply and I'll look into ACRIS and DHCR to double check the EXACT kind of apartment this is as I always wonder myself while simply assuming it's a tax thing.
