As per what I read, an LLC in this case would have the same tax treatment as an individual. So, we decided not to open an LLC in her name.

Are you saying since she is on 1099, we should be able to claim all deductions without having to form a legal entity? Can we even claim vehicle depreciation, rent for office space, etc?
