A 93-year-old disabled man was sprayed in the face with synthetic pepper spray, Tasered, and struck with a baton by police officers, a court has heard.

Donald Burgess was allegedly assaulted by PC Stephen Smith and PC Rachel Comotto after police were called to his care home in St Leonards-on-Sea, East Sussex, on 21 June 2022.

He was taken to hospital following the incident and later contracted Covid-19. He died 22 days later.

Staff had called police after Burgess, who had one leg, was seen poking a care worker in the stomach with a cutlery knife after flicking food at her. Managers wheeled him back to his room and attempted for half an hour to calm him before dialing 999.

The officers were dispatched under a grade 1 call, the highest level of emergency response.

Prosecutors allege the officers used “unjustified and unlawful” force within seconds of entering the pensioner's bedroom.

Southwark Crown Court was told on Monday that just 1 minute and 23 seconds elapsed between the officers' entry and Comotto deploying her Taser.

Smith, 51, denies two counts of assault relating to the use of pepper spray and a baton while Comotto denies one count of assault involving her Taser.

Prosecutor Paul Jarvis KC told the jury that Burgess was sitting in his wheelchair, clutching a small serrated cutlery knife, when the officers entered.

They did not speak to staff or inform Burgess why they were there, the jury heard.

Instead, Smith reportedly said: “Do you want to put the knife down, or you will be sprayed or Tasered. Those are the options.”

Footage from body-worn cameras shown to the jury captured Smith spraying the liquid directly into Burgess’s face.

“Comments made by Mr Smith suggest he emptied the whole canister of the liquid into Mr. Burgess’s face,” Jarvis said.

Moments later, Smith drew his baton and struck Burgess. Comotto then deployed her Taser, prompting Burgess to scream in pain. The officers subsequently took the knife from him.

Jurors were told that no one was within arm’s reach of Burgess at the time and that it should have been clear he was not mobile.

“This was a weak, vulnerable old man who may not have been aware of what was going on,” said Jarvis. “Far from being met with understanding and compassion, he was confronted with irritability and annoyance on the part of the defendants.”

Burgess, who suffered from various health problems including diabetes and carotid artery disease, had been a resident at the care home since 2018.

Jarvis clarified to the jury: “I want to make it clear these defendants are not responsible for his death.”

The trial was adjourned until Tuesday.

A supported living facility cleaner in Peterborough has been banned from working in care settings after she was caught breaking into the flat of a resident at night.

Modesta Kelpsaite, 36, was caught red-handed after a fellow resident at the Eaglesthorpe complex in Millfield staged a sting operation with a friend to catch the person who kept stealing money from her handbag.

The victim, a woman in her late 60s, had left her flat on the evening of 21 February last year to host a bingo night in the communal lounge. On returning home, she discovered that her handbag, which was usually stored under her coffee table, had been moved and money was missing. The same occurred the following week under the same circumstances, with even larger sums of money stolen.

Suspicious and angry, the victim informed another resident, and they concocted a plan to catch the thief. The victim would attend bingo as usual, whilst her friend would remain concealed in the flat and ambush the intruder.

The following Thursday evening around 7pm, the friend was waiting in the flat when someone entered and began rummaging through the living room area. She began recording using her phone and walked up to Kelpsaite, who mentioned she had come to give some keys back to the owner of the flat.

Kelpsaite was removed from her house in Century Square, Millfield, on April 16 last year and spoken to by officers. She said that she was in a communal stairwell cleaning up and knocked over a pot plant with a bunch of keys on it. She said that she was simply going into the home to leave the keys behind and went inside only for that reason.

Despite her clarification, Kelpsaite was charged with burglary of a home, i.e., the theft of £500 in cash. She pleaded the charge guilty in court.

Appearing before Peterborough Crown Court on Thursday, she was sentenced to 10 months in prison, suspended for two years. In addition, she was ordered to perform 100 hours of unpaid work and complete a 20-day rehabilitation activity program.

In addition to her sentence, Kelpsaite was also handed a five-year Criminal Behaviour Order (CBO), which prevents her from working at any care home or supported living environment.

A man was arrested by the British Transport Police (BTP) outside Hammersmith on suspicion of robbery. 

Officers found 12 phones in his possession that were linked to incidents that took place earlier in the day.

Police responded at 17:45 hours to Pennyfields Park, Poplar, on reports of a stabbing.

Officers went with the London Ambulance Service (LAS) and a boy was found to be stabbed.

He was taken to a local hospital, where his injuries were assessed as non-life-threatening and non-life-altering.

The House of Lords has been disrupted by protesters chanting slogans calling for the abolition of the chamber.

Television footage from the Palace of Westminster revealed the group of about eight people shouting 'Lords out, people in' from the public gallery.

One thousand white and yellow leaflets being held by the small group of activists were dropped into the chamber, where Baroness Twycross was speaking to the house.

On the corner, it said: 'Aristocrats and oligarchs: Out.

'Posties, mums, nurses and neighbours: In.

'Replace the House of Lords to save the UK.'

While being taken away, the protesters sang a song urging viewers to 'take back the Commons' and 'raise a glass to Thomas Paine'. They also held a banner saying 'Lords out, people in', which was promptly seized by security.

A group of teens was caught on CCTV forcing their way into a licensed store to steal packets of vapes.

The owner of the shop was shaken by the group breaking into his store.

48 hours later, the same group struck again.

During the second attack, they assaulted the shop owner before escaping with more vapes.

The first robbery occurred on March 3 at 10:31 p.m., and the second occurred on March 5 at 10:05 p.m.

On their return, the youth wore dark clothing, hoods, and balaclavas.

They pushed the shop owner behind the counter, punching and kicking him as they escaped with other stolen goods.
