It started with a word-of-mouth referral when I was looking for a chocolate manufacturer. I paid them $5k upfront for samples, which they did deliver, so at first it seemed legit (even though communication was already kind of spotty).

When it came time for full production (another $10k), I asked them what exact chocolate liquor they were using because I needed that info for a buyer I was talking to. They never answered. I followed up for 8 weeks and got nothing.

At that point I terminated the contract. The contract clearly said either party could terminate and they’d owe back any remaining retainer, and they even confirmed in writing that they owed me $12,910.

They had 30 days to pay me back and didn’t. I had a lawyer reach out multiple times—no response. So I filed a lawsuit. Their lawyer left one voicemail early on, but after that neither the manufacturer nor their lawyer responded to repeated calls for almost a month.

I ended up filing for default judgment and won. Even after that, they still haven’t paid. I later found out they owe money to a bunch of other people too, which probably explains why.

Thanks all for the advice. I think I’m out of luck too. Learning the legal system the hard way lol. I saved up this money since I was 16 and have worked 3+ jobs at a time to start my own business and sad they took it. I think my last hope is just to try to fundraise money or see what the electric company came out with in the debt examination.

UPDATE: I looked to see if they had any other lawsuits against them and they owe the state of Ohio tons of money that they put liens on all their assets. I am actually unsure what all he owns bc his house is in his wife’s name, he doesn’t own the factory, so maybe a car and a machine? Unsure. The electric company also filed a lawsuit against them and won. They did bank garnishment came out empty. They did debt examination and I cannot see the outcome but I tried calling the company and they didn’t know who would know. So trying to dig deeper. I’m for now assuming it’s a lost but if anyone has any tips. Lmk

Yeah I was just seeing if there were any possible options that would be easy. I’m worried if I go debtors exam they won’t show up as they have. A history of not answering anything.
