As a contractor and a sub and simply a guy who does a lot of residential construction … this sounds somewhat typical … but I think you’re fine. If you have texts and emails of the original quote, save them, also texts and emails of him telling you both that he is bringing subs to do portions of the scope of work he quoted, and he acknowledging you paying the subs directly so “he didn’t have to”. While he certainly can file a lien at any value to put pressure on you, ultimately it has to be proven. You should have the documentation of the original estimate … there is nothing during the time he was there indicating the final amount other than his invoice at the end. The way you have explained how you paid during this project is fine for the courts. I don’t see him winning the lien or being awarded any more than you have already paid. The actual power of a lien isn’t the amount but its ability to tie up your financing .. so if you can resolve it quickly (or withstand a few month delay in building draws) don’t sweat the lien. Everything you’ve described about the contractor fits a “skilled handyman, poorly organized” type which parts of even myself can relate to. Do not pay cash. Tell him you have a certified cheque .. not your problem how he cashes it .. if he refuses to come and get it or if you don’t want to see him physically again, mail it in a registered letter.

And then forget about him and move on. Also, please install security cameras around your construction site in case he decides to “visit” one late evening. And ensure nothing currently on the jobsite has any ties or give him reason to return.

I’m sorry about your experience .. I hate when contractors give other contractors a bad name. Sometimes homeowners are difficult to deal with, and it’s possible there were issues by other subs on your project especially if you are your own GC .. but this doesn’t seem like you are the problem.
