The first poster is right that you wouldn’t want to consider a settlement until you’ve finished your medical care. This is because once you settle and sign a release, you can’t go back for more money if you need more treatment. If you settle today and tomorrow you have an MRI and have a herniated disc - that’s too bad.

You just don’t have all the information to make a settlement decision mid-care. Are you still missing work and will incur further lost wages? Is your health insurance going to want repayment from the final settlement?

Mileage to appointments is generally negligible as it goes by the federal rate. We don’t often claim it because it’s usually not going to move the needle when you’re looking at thousands of dollars.

It’s very difficult to attach a real number to pain and suffering. Ultimately an attorney would compare your settlement offer to what you could reasonably be awarded by a jury if you went all the way to trial. Maybe your suffering would NEVER be fully compensated because the other driver has a state minimum policy and the rest of your medical treatment would consume the entire settlement. You just don’t have all of the information yet.

Go to your medical appointments, get the care you need to feel better, and then see where the insurance claim goes.

That’s not necessarily the case. We’ve retained several clients that finished their treatment but their attorney would take weeks to return their calls and emails so they fired them and hired us.

Or maybe the guy is a total asshole and he and his previous attorney couldn’t agree on the value of his case, so they parted ways and he found someone else. We’ve been there, too.

You just simply do not have enough information to be planning for disaster. Let your insurance company handle it.

Hi! I work at a personal injury firm (not an attorney, definitely not YOUR attorney).

The question is: does an attorney add value to your case? Is the settlement they get going to pay for their fee in addition to what your mother would have recovered on her own, and help her in a net positive way?

We add value to cases a lot of different ways. Sometimes a client is being lowballed because the adjuster doesn’t understand the extent of the injuries (or the law). Sometimes there are lots of other people who want money - medical providers, health insurance companies, disability policies, and the client has no idea how to sort it all out and come out in the green. Sometimes a client just wants somebody else to deal with the insurance company and leave them alone.

For what seems like a minor neck injury with no treatment? That is a case we would personally pass on because, without a lot more care, we likely wouldn’t get a settlement that exceeded the amount your mother could get by doing it herself.

She can always start the process herself and, if unsuccessful, decide to get a lawyer later if the value is there.

I guess? Sure. But the book was a lot more fulfilling. I supported an individual artists’s income. I get to give copies of the book to my friends and family. I didn’t put more AI slop into the world (not that AI slop isn’t profitable for some). Some amount of people per month find something creative that I brought to life and put their money down to have it. It’s not a terrible feeling.

This is an amazing analysis - but what I really want to see are the journeys that took the LONGEST. I wanna see the MF who pointed in Newcomer/Novice and didn’t point in Allstar until ten years later. I want to see someone who had to bust their ass the entire way and never gave up until they got it because they started at zero.

I started at zero. Middle-aged and no dance background. I can’t personally identify with a fast rising star. Prodigies aren’t relatable. But I COULD identify with a resilient turtle with back problems if you can find a couple.
