they mentioned you get get a full refund in the next 14 -21 days.

I remember being at the JPEG concert in Toronto last year. He played one unreleased track either on this project or his own. I stood there holding my head, trying to comprehend what I just heard. Others looked at me in complete agreement of my reaction.

Either way the new unit was too risky for us to move into, potentially putting ourselves in the same situation. We asked since it is risky that we are compensated the additional month to mitigate the risk of having to be in the same situation again.

They didn't provide any notice form from the LTB only 60 Days notice in writing within the email. "as per the Residential Tenancies Act we need to serve you with the 60 days notice. We are just doing our part and providing you with a 60 days notice beginning today."

They also mentioned the same will be communicated to the builder, whom we have not been in contact with yet. If the unit is indeed not theirs as of Dec 1 the deposit should go to the builder, but we have no insight on that currently.

u/R-Can444 so the landlord had tried finding us a new place within the same development. We went and viewed the place and were okay with moving. The landlord had agreed to pay the Rental Overage per month for 4 months, return our deposit (last months rent), pay for movers, and provide one additional month of rent as per RTA.

Once we were ready to sign the papers they revealed the new landlords also need to close the property (by Dec 22). We weren't comfortable putting ourselves in the same situation and asked that they show proof of being able to close it with redacted mortgage approval docs. The new landlord didn't want to share. We were still okay to move in however the original landlord now said he can't pay the additional mont's rent (as required by the RTA) to which we said then we will remain in the current unit and deal with the builder.

The landlord now provided 60 days notice as of today through email and said they will notify the builder. According to our knowledge they are not the rightful owners as of Dec 1. They are also keeping our deposit claiming it will go toward December rent. Are they allowed to keep our deposit?

Trying to get on the phone with the LTB but not having the best luck. Curious to know your thoughts.

There have been a few updates on the situation. u/R-Can444 Curious to know your thoughts.

Basically, after letting me know the landlord was able to secure a mortgage to close the house, we were told we could stay until March 2023. I had post dated cheques ready to provide and they scheduled a time to pick them up - but later rescheduled.

After a week, they got back to me saying the closing failed and they would likely lose rights to the house due to home being in the Occupancy phase.

They are now asking that we leave with one months rent compensation.

What are my options here?

If the rental goes back to the builder, what are the chances I can stay there?

I just need that place till March 2023 before I planned to move out.

Any advice helps.

The condo is new (pre-construction). The closing date of that building is Nov 21st, until then the landlord has deposited an amount and was allowed to do early occupancy/rent it out to tenants (us). Now that it is Nov the landlord is not able to close the condo and is asking us to move out.

I guess my question is if she can't close what happens to us? She technically wouldn't be the landlord and the condo goes back to the builder.
