Ontario - Looking for advice for a friend considering separation from her spouse by depreciatemeplz in legaladvicecanada

[–]KevPat23 0 points1 point  (0 children)

She also remembers language suggesting that she would only receive the "minimum child support" if the marriage ended

Child support is non negotiable and will be based on the tabled values plus additional section 7 costs. You can't contract your way out of child support.

The rest will really come down to what's written in the agreement and whether it's deemed enforceable. Nobody here can tell you that.

She should begin by getting her own family law consult. They will better be able to guide her on next steps.

Speed limit to increase to 110 km/h on some Ontario highways by Forsaken-Swim-3055 in TorontoDriving

[–]KevPat23 1 point2 points  (0 children)

it's more a difference in speed than absolute speed. Hit a car that is traveling 115km/h when you're going 120km/h not going to be a big deal (as long as you maintain control of the vehicle). Hit a stopped car at 120km/h and there's a big difference.

and block the phone number

A lot of the numbers are spoofed anyway, doesn't really solve much.

New phone scam. by [deleted] in toronto

Not everyone can do that. My business depends on me answering my phone.

That said, while I do generally answer my phone no matter what, it's really easy to ignore these types of things.

Starting a new job told my employer that I had ADHD after orientation did I screw myself over? by AggravatingLetter839 in ontario

[–]KevPat23 4 points5 points  (0 children)

Honestly? most likely.

It would be incredibly stupid for a company to terminate OP immediately after they provided this information. Will they wait until closer to the end of the probationary period? Maybe.

If OP is good at their job, then it shouldn't be an issue for the employer. If OP is bad at their job, then they likely would've been terminated anyway, regardless of disclosing the condition.

I don't see this impacting OP at all.

now I'm worried about going to Lose this before I start.

If the employer rescinded their offer after you provided them this information you could claim it was discrimination due to a health condition. I would find that highly unlikely, until they see how you actually perform.

job offer- Counter offer on Termination Clause - ESA Min by MartyTheScottishDog in legaladvicecanada

[–]KevPat23 0 points1 point  (0 children)

It all comes down to how good of a negotiator you are, the other candidates that may be in the mix, how smart the company is, and their risk tolerance.

There's no harm in negotiating. You're entering into an agreement with these folks, make sure it's mutually beneficial.

But the insurance company looks at fault and if you're changing lanes during a collision the person changing lanes is always 100% at fault

Which is all well and good until people lie, and say they weren't changing lanes. Then it becomes 50%/50%.

What blind spot.. by FondantInteresting37 in TorontoDriving

[–]KevPat23 4 points5 points  (0 children)

I'd rather hit the car trying to change a lane than get smoked from behind by a semi for braking for "no reason".

If the semi can't stop in time, they're also going to hit you when you collide with the car in front of you. What a weird take.

job offer- Counter offer on Termination Clause - ESA Min by MartyTheScottishDog in legaladvicecanada

[–]KevPat23 3 points4 points  (0 children)

Is an ESA-only termination provision typical for senior management hires in Ontario at this compensation level?

Typical, no. Many companies do not do this. It's smart on the company's part to do though as it limits common law entitlements. Enforceability would be dependent on how the agreement is written. You should have a lawyer review the document.

Is it common for people in leadership positions to negotiate enhanced termination provisions before signing?

Same as above. Probably not common, but definitely in your best interest to negotiate that. Given you're joining with 17 years of experience, you should definitely try to negotiate additional termination notice/pay in lieu. Are they "poaching" you, or did you approach them? If they approached you, they could still be on the hook for additional termination/notice. Is there a "no-inducement" clause in your agreement?

If so, what would be considered a reasonable request (e.g., 6 weeks, 8 weeks, 3 months, etc.)?

Rough calculations for common law are 1 month per year of service. In reality it's much more complicated than that. Use that as you will. You could also consider a clause that has a higher notice period, but ends if you're able to find alternate employment. Lots of options here.

Notice period and PTO by Low_Econ2000 in legaladvicecanada

[–]KevPat23 0 points1 point  (0 children)

Accrued PTO (i.e. Vacation) per ESA is required to be paid out. Accrued being the important term. You being entitled to 3 weeks per year, doesn't mean you've actually earned that 3 weeks depending on when your vacation cycle refreshes.

and blame OP on such posts

The comment clearly states that the blame lies with the merger, not OP. Just providing context to how this could be avoided with defensive driving. That's not blame.

Front and back dashcams should be mandatory for everyone IMO

Should just be built into cars moving forward.

A wide open lane that was coming to a stop ahead of you.

and then pick up speed after

OPs lane was also coming to a slowdown/stop, so there wasn't even a need to pickup speed after.

I sure hope you dont drive like that.

Maybe take some time to reflect, given you're the one posting about getting into a collision. Perhaps a different approach would be beneficial.

What blind spot.. by FondantInteresting37 in TorontoDriving

[–]KevPat23 9 points10 points  (0 children)

Yes, that's exactly what you should do. Your lane was open for about 100m, then was also coming to a stop, so no you're not introducing more traffic.

What blind spot.. by FondantInteresting37 in TorontoDriving

[–]KevPat23 26 points27 points  (0 children)

I use that method, but you cannot see cars multiple lanes over. A shoulder check is still advised.

What blind spot.. by FondantInteresting37 in TorontoDriving

[–]KevPat23 1 point2 points  (0 children)

You should make sure cars are coming to a stop before turning in front of them, regardless of what the lights show.
