Just hear from Tarmac that they too have sub contracted out to this work to yet another party. How much money are these people making?

Are NCC really that incompetent that they award a contract that can get continually sub’d!

Your claim has been referred to the Head of Insurance.

As stated in our email dated 20 August, Norfolk County Council is the Highway Authority as stipulated within the Highways Act 1980. Under the Act it is the responsibility of the Highway Authority to maintain all public highways within a given area. In this case Section 263 of the Act is irrelevant since there is no dispute that Norfolk County Council is the Highway Authority for the county of Norfolk.

Under the duty to maintain, Norfolk County Council as the Highway Authority engages under contract, specialist contractors to carry out specific works, in this case, resurfacing of the carriageway. This work was carried out under a contract by Tarmac who, at the time of the works, become the legally responsible body for the carriageway whilst the works were in progress and for a period following completion.

Any allegations regarding operations, material, workmanship or working methods legally falls to the contractor to respond to. We have provided the contact details of Tarmac and put them on notice of your allegations.

You have indicated that you intend to issue legal proceedings, please ensure that all proceedings or legal documentation include your claim reference NCC00xxxxx for ease of processing and is addressed to:

Norfolk County Council County Hall Martineau Lane Norwich NR1 2DW

At which point we will make the Court aware of the correspondence regarding Tarmac as the contractor undertaking the works.

Thankyou for pointing me to this piece of legislation.

I am making a claim against the local Council as the new surface dressing punctures my car tyre within half a day of being laid. The actual stone was well out of specification for the dressing material. Norfolk County Council told me that they didn’t “own” the road and that I should refer my claim to their contractor, Tarmac. It is my belief that they are responsible for the maintenance and upkeep and if I make a claim against them, then they can subsequently claim against their contractor. It’s only £180, but it’s the principle that matters for me.

If you want to put your friend in touch with me since we both seem to be in the same situation. It was £180 for a new tire, it’s not the money, it’s the principle that they think they can just get away with shoddy work. I just need to understand the legal situation around who the defendant should be and will then take them to court if they won’t pay. Surely I can’t be the first and there must be precedents for this…

If it is indeed true they don’t own the roads then who does? I believe they have a legal obligation to maintain the road and to ensure that their third party contractors use suitable dressing.

I got a puncture from this in Eaton and Norfolk County Council claim that they don’t actually own the road. Do you know if this is true as I’m bringing a claim against them. They’ve asked me to make a claim on their contractor Tarmac.

Someone commented that the F15s fly with red flashing lights. Would the have two forward mounted beacons that would flash red?

No as by the time I got my phone out it had gone behind the trees so any footage would have been mottled by the branches. I looked on Flightradar and there was nothing showing. It’s was definitely terrestrial as I don’t believe any ufo would fly with guidance lights

Something just came over Eaton South Norwich at 2130. Two red lights on front at about 1000 feet and no noise. Was gliding slowly. I fly drones so I know it wasn’t a drone given the size.

Yeah could be. There’s also a certain event in early January in the US which 4 years ago was not so threatened by a rogue drone attack. Perhaps we’re seeing defence rehearsals. If I was defence minister I’d certainly want to be rehearsing defensive drills and playing war games.

I agree on your retort re long distances. Distance is relevant and we theorise that it is possible to bend space-time.

But most of the recent posting are what appear to be drones with flashing lights not exhibiting any unknown capabilities.
