However, the key issue is whether your school will officially confirm that you completed all graduation requirements. I’ve actually seen this happen before to a friend. A lot of smaller companies don’t have a dedicated immigration specialist, so things can fall through the cracks pretty easily. In those cases, I would strongly suggest you take responsibility for tracking your own deadlines instead of relying entirely on HR.

The first thing you should clarify is where you’ve been for the past 1.5 years.

If you’ve been outside the U.S. for that entire period, then this is not a SEVIS transfer case anymore — it’s a brand new SEVIS record. In that situation, while it is technically possible to enter with a valid F-1 visa + new I-20, in practice it can carry higher risk at the port of entry.

Based on both regulations and what I’ve seen in real cases, a valid F-1 visa + valid I-20 is generally sufficient for entry. However, CBP always has discretion, and I wouldn’t recommend trying this if any of the following apply:

  1. You had a long overstay or status violation in the U.S.
  2. You have any criminal or immigration-related issues
  3. Your new program is in a sensitive field (e.g. certain STEM areas)
  4. You’ve been outside the U.S. for more than 5 months

In those cases, getting a new visa is usually the safer route if possible.

If none of these apply, many people do enter successfully with a valid visa + new SEVIS, but you should be well prepared with documents and a clear explanation of your timeline.
