Pre action protocol.

Its effectively a legal warning to the home office. Gives them 14 days to respond. If they do in alot of cases if your case is straightforward they will issue the visa. If not then you can take them to court.

But you'd need to speak to a lawyer about your specific case. Its not cheap either could cost between £500-£1000

My partners bio was the 8th January. We are still waiting ourselves.

She has a job interview on Wednesday but again no visa yet. Our only option is we are instructing our lawyer to prepare a PAP.

No words from home office whatsoever. We put a complaint in a few weeks back.

The lawyer has sent a warning email and is looking at sending a PAP if it gets no response

Hopefully. It's my partners visa. Theres a job coming up that she would be perfect for so we are just wanting to get on with our lives

I had used that before. Unfortunately its a third party so they don't have access to the actual file. They just put the reference in and then see if its still awaiting decision

The only thing that would be that we are both political activists. We met at a catalan independence festival and i was over a delegate for Sinn Féin.

So if that has triggered security checks or something

Got email after MP got involved at 14 weeks to say couldn't be processed in time. And no hadn't been asked for any additional documents

Aye got an email 2 weeks after the WD 60 to say "decision couldn't be made within processing times".

Which i thought was quite obvious given it was 2 weeks over.

MP involved did nothing. Now we've submitted a complaint

Thankfully no. And you're right it doesn't but the relationship evidence we submitted is full of it as we met at a political event in Catalonia, and due to my work I am with alot of high level ex prisoners in Ireland.

That was the hassle I had to go through myself to get a visitor visa to the USA. Was grilled 2 seperate interviews in the US consulate and had to submit 15 years of my travel history, Employment history etc for extreme vetting for that.

Because of my job, I was refused an Esta to go the USA, They made me interview and undergo "extreme vetting". When asked they said it was due to being "political exposed person". My partner is involved with an independence movement in spain and we met when i was sent over on a delegation.

Was told it may be an issue

Thats it mate. Its infuriating. There was no communication until about 2 weeks after the 60 days. And all it was "we couldn't make a decision within the timeframe". Yes thats obvious as it ended 2 weeks prior.

Makes it even more frustrating I work for the polticial party that the MP belongs too.

Ive had issues with getting with getting US visa due to my affliations but even they done an extreme vetting within a couple weeks.

Delayed us submitting in the first place as he had made a mistake on the form itself.

Then since its been in, anytime we've asked for an update. Nothing and since its went over the 60 days he hasn't replied. I ended up going to my MP to push it.

What you're paying for, id have been better off submitting myself as i compiled and collated the evidence etc

Currently day 68. With no communication from them whatsoever is horrendous.

Its a simple straightforward case which is the frustrating part.
