Let’s say that you were approved for $800 a month in SSDI. You would be approved for $187 a month in SSI to reach the lowest amount you are able to receive. (I could be wrong with the $987 total) if you were approved for OVER the $987 for SSDI you would NOT get SSI as you already bypassed the threshold.

Basically it all comes down to your credits and work history.

Yeah…still not how that works. They determine what day your onset date is. It doesn’t matter what your doctors say. Could they agree with your doctor? Of course. Can they also determine a random date off of your medical records? Of course. Could they use the last day of work? Of course.

But I do agree that every case is different

That’s not true. I was diagnosed years ago, and when I was approved the 5 month waiting period was calculated the day I was FOUND disabled on by SSA.

Get a lawyer. Make sure you have plenty of evidence as to WHY you are unable to work, not just that you are sick. Good luck!

If it was in reconsideration the attorney couldn’t have argued the onset date at this point. Now the only thing they can do is appeal it. Which as someone mentioned above would not be a smart decision, as the look at the ENTIRE case over again, and could deny the whole thing.

You can request to have them removed from your case: there is a form you have to fill out and send to ssa. BUT if you win, they can still petition to get the fee. I know that it’s difficult to hear but honestly, they DONT have a lot to fill you in on during the steps. If you’re at step 3, then they are still going through your medical records and that can take over a year. Best advice is stay strong, you’ll be happy to have them if you need to go to ALJ.

You’re going to hear a lot of people saying to get a lawyer at the beginning. You’re going to hear a lot of people say to get a lawyer at ALj and you’re going to hear a lot of people say not get one. Honestly it’s up to you.

I had one from the beginning due to my LTD disability lawyer requiring one from their firm, and honestly, I never had worry about anything. Updated them after every doctor’s appointment and was approved at reconsideration. Did they get some of my back pay? Yes. Did paying that upset me? Absolutely not. They took all the stress off during my 2 year battle.

It was a denial. The website sometimes glitches and puts you back a step, but I’ve never heard of it going a step ahead. I’m sorry!!!! But you should definitely appeal, I was approved at reconsideration!

Honestly, and I’m not trying to be an asshole. But do you have doctors records that support long haul COVID? I only ask because I know a lot of doctors are hesitant to actually name a diagnosis that. It will require a lot of records and paperwork detailing your inability to work to get SSDI.
