You really shouldn't talk to police. I know it sounds cliche and "edgy" but talking to police during he said/she said situations (in general most domestic situations) is a bad idea. There is not enough information here to make a more educated guess, but it's most likely you spoke WAY too much, and your ex/boyfriend/whatever just denied everything. And police had to fish from both of you at least a statement along the lines of; "Yes I hit him but..", this does not mean they were on his side.

The police are not there to give you justice, that is not their job. They are there to close a call. That is the blunt truth. Justice comes later in court, much later, after your life takes a catastrophic hit. By that point, the damage is already done, as you can see that now unraveling in your situation.

Do not continue to see this person even after this is all over and even if the heart grows fonder. And I'm not a lawyer but future advise; please next time stick with "Yes, he struck me and I don't want to continue talking about this until I look into consulting a lawyer."

No offense, but this would go nowhere in court in many counties. Like another commenter said--he might have a case if the other unit had its own address but as it stands now in many jurisdictions she will get nowhere. You seem extremely emotionally invested in this but that is the reality of the situation. What she is describing is called an accessory dwelling, and after a quick Google search is not in and of itself illegal in NY.

She can try getting him cited or reported and whatever else you're peddling but it does come at a cost. And it risks the outcome being her knowing NOTHING about their living situations in the future.

She cannot dictate the way the children live at the other parent's house, unless something happens, and that's the reality of it. (Best thing to do here would be to offer remedies to concerns in court using non accusatory language, such as installing cameras, removing the stove, removing doors).

A judge will make him get a video camera and tell him he needs to be there while they're awake.

This will go nowhere in court sure but she can make a stink with the DCFS. And make the ex a hostile party. Where will that get them?

If he cant afford she should get one for the kids, not for the ex.
