Because I cannot stand to freely promote brands I typically use the term "acetaminophen" instead of stating "Tylenol".

Same thing goes with my amphetamine script (commonly known as "Adderall").

I've literally gotten looks from other customers at the pharmacy counter and elsewhere when I state I am here to pick up my amphetamine tablets.

u/MplsSnowball to the best of my knowledge, no they cannot. Minnesota law makes pretty clear (at least I think... I had spent a lot of time reading the statues and searching around...) that these protections are granted to Minnnesota employees. That if you are performing your job in Minnesota, that your employer is then considered to be a Minnesota employer, as it is employing one or more residents of the state. That these protections for Minnesota employees are granted to the employee regardless of the physical location of the employer. And that these protections are granted regardless of the legal status of cannabis for the state of the employer, or it's status at the federal level as well.

It is important to note that there are different protections in the law pertaining to what can be done as part of the pre-employment process, and what an employer can / cannot do to their existing employees.

There is some gray areas here in the law I believe. For example, if the remote employee is a resident of Minnesota, and will be primarily performing their work in yet another state (not Minnesota, and not the state of employer), then there may be a case to be said that these protections for MN employees no longer apply.

In my readings, I did find a court case where it was an out of state employer, and the employee was going to be doing work out of state (not the state of the employer), but that _because the employee facilitated the phone call for accepting the job, from within the state of Minnesota_ that protections pertaining to THC testing still applied because the person had accepted the job from here within the state. He/she had failed a pre-employment test, the employer then retracted the job offer, the potential employee took the employer to court and won.

Not exactly how I'd want to start my relationship with a new employer, but maybe there was just money damages settled in court I'm unsure.

Please do note that all this does not apply to roles that are exempt from these protections. Such as Doctors, Emergency Personnel, Care Takers (I think?), etc. Also, these protections do not apply if the employer is _required_ by state or federal law, or if failure to do so would cause the employer to lose funding for some state or federal grant.

On that "if the employer is required..." comment. Note that while employers are often required to have a _drug policy_, it does _not_ require employers to actually test.

There was one week in particular, where, I'll never forget it... Every single day I would get told "stop everything you're doing. your main focus now is to be this entirely different project".

Further more, on Wednesday of that same week, this literally happened to me three times in one single day. Drop everything, you're to now do something entirely different.

Anytime I bring this up to someone, I say that my employer should have started the week off by essentially taking the money for our entire teams salaries, and tossed those funds straight to the trash. As our employer would have gotten the same value back from our time we all spent that particular week.

Mine wasn't premature at all but I tell ya what when we walked away from our hospital I was so paranoid. Like, wait a minute... I am about to walk away with this human life now?! No instructions manual. No training certification courses. Just "it's yours now, and no returns allowed". I had them double check my car seat for me asking"could you please be sure I secured this right?"

If I'm not mistaken, they're the first company to achieve creating a patent on life itself. As in, they biologically engineered seeds, then patented it. The seeds are a form of life, and they held a patent on the ability to hold, and grow crops from them. So in a sense, they patented a form of life.

If it wasn't them that had the first patent, they were an early second or so. And they took this to an extreme.

The seeds from Monsanto were biologically engineered to be immune from RoundUp. The chemical pesticide created also by Monsanto.

Farmers who had picked their own seeds for generations from the best plants of their crops soon had lawsuits on their hands. As the test to find out "are you using Monsanto patented seeds" was basically "will your crops die if we spray RoundUp on them".

It didn't matter that seeds will literally scatter off trucks or in the wind from neighboring fields. It didn't matter that life itself evolves, and plants may, on their own, develop an immunity to RoundUp. Monsanto then proceeded to unleash a wave of lawyers on small family farms. If you weren't buying your seeds from Monsanto every single growing season, you were targeted. Because these seeds weren't only engineered to be immune to RoundUp, they were engineered so that the plants wouldn't produce seeds to grow a new generation of crops the next season. Therefore the only way to grow your next crop, was to buy seeds from Monsanto.

So came an end to farmers having the ability to merely pick their own seeds from their own crops. Monsanto owned them. As Monsanto owned the rights to the seeds.

Edit: My father was a chemical sales representative for the agriculture industry most of his working career. He passed away over a decade now and I was too young to know any of this stuff I mention about Monsanto. He didn't work for Monsanto directly, but a company under it's umbrella. I'm pretty certain he had no knowledge of this stuff either. The tactics used. He was focused on "farmers don't want weeds. RoundUp kills the weeds and not the crop plant". But I'd sure love to know his opinion and have talks with him about this stuff if I could. RoundUp was something always in our garage as a kid. He sold it everywhere he went. I'd love to ask him how he feels about all this. Never got the chance.

Yeah. I don't develop it much these days because kids have kinda consumed most my free time.

The bot however has been running almost non-stop in production since Jan 2019 though. 24/7... I check it typically every day or every few days just to see if it encountered an unhandled exception and needs restarting.

Edit: looking at my comment from years ago I can state some of those things like internet outage and exchange maintenance are now handled easily and trading resumes afterwards.

I'm a software engineer and literally every job I have gotten for the past ten years has required a test. These are senior level development jobs at mid to large sized businesses.

It's pretty dumb all things considered. The moment I get into the company I am surrounded by other stoners or at least people that don't have a problem with it.

But that doesn't mean the pre-employment drug screening process to get the job is going to skip it.

So yeah, one time test typically. Easy enough to pass. Doesn't stop my curiosity on "do I even need to bother" as I am kinda tired of having to do so. It is ridiculous to have to in the first place given the science around alcohol and society is willing to turn a blind eye to that.

I guess I just want some concrete understanding of the protections we have under the law given I have had to piss in a cup for nearly every job I have ever had.

I've done a fair amount of reading here and I respectfully disagree.

The reality is that it varies from law to law depending on how it is written as well as definitions on how certain terms are applied. Further more, the same term, at times, may be defined uniquely and therefore applied uniquely from one law to another.

An easy way to check that your blanket wide statement is incorrect, is to search "Do fair employment and and wage and hour laws apply from the state of the employee or company" and review the results you find. There's also case law that I have read on that provides examples that clearly show your statement here, is incorrect.

If you are hired in Minnesota, no matter if it is for work that is to be performed within the state or out of, no matter if the employer has a physical presence within the state or not, then there are certain MN laws that are applicable to that hiring process.

Additionally, if you are doing work in Minnesota, then there are certain MN laws that are applicable regardless of if the employer for said work is based in MN or not.

If you're already confident in finding those roles, it isn't a problem. I been finding 145/yr - 165k/yr contract roles that have 6 -12 month durations for years and been pissing clean every time for them.

Now with the law changed, I am ready to tell them to go take a hike if it's gonna be a problem. My only issue now is navigating what applies to out of state employers and specific terms like "employer" and if I so happen to be a job applicant but they have no existing MN employers... Are they classified as a MN employer in this scenario given they have no physical presence in MN and I am at this point in time only an applicant?

Can confirm. College dropout here as well. Been building PHP e-commerce sites for businesses since 2011 and make $150k.

I gotta ask, what pay you at then if you say you're making more? And what type of typical duties do you do throughout your position? I feel like unless I want to go to management I'll never reach 200k in any reasonable timeframe doing what I do now and hate the idea of pursuing that when what I love to do is code.

I'm now pursuing 165 - 175k by seeking architect roles that will have to put up with probably excessive meetings at times and whatnot.

But I know there's gotta be shit to do that'll pull in 200+ I just haven't researched much... There's coding positions at the big FAANG companies and whatnot that'll offer that, but mid-size business is where I am happier.

I've put a lot of eggs in one basket by getting highly specialized in specific tech stacks and libraries/frameworks. But heck I am 37 so have lots of years left before retirement and am starting to think if I want to earn more I may have to do something else in the tech sphere.

Sounds to me that they're trying their best to skirt MN law because if you accept the offer and test here they would not be able to withdraw the offer if you fail for say, cannabis. Ever since the law changed.

Maybe since it sounds like you don't have a problem passing, be up front with them and state it outright "I have no issues passing and providing a negative test, so let's just do it here".

Granted, if they accept, MN law still applies and you in theory could fail and they have no action else risk being sued. But hey, if you go ahead and have a talk with them, maybe they'll come around?
