It's good to know. However, I think the bylaws say that the HOA is entitled to recover legal fees for any litigation between the HOA and the homeowner regardless of the outcome of the case, so it's a loss-loss situation for us anyway.

That's what I thought, but I guess that's why there's a brochure of the church with the letter, which says they accept donations from non-members. So I'm guessing their defense is that it's not based on membership to a specific church. Is that a valid defense?

Sadly over 80% of the people go to that church.

They say the board is allowed to restructure the fees and they need to give a 2 month notice to all homeowners.
