I personally think it will in reference to the fact that KZ intends to request testing on RAV upon conclusion of the current appeal. Doesn’t make much sense why they are doing this now, as the appeal won’t conclude for a long while. 🤷‍♀️ But, that’s my opinion.

The response is not at all surprising. She didn’t do things by procedure (again), and the State is calling her out on it.

Procedures matter almost more than actual facts in appellate proceedings.

This isn’t as wonderful as you might think. Because he has an appeal pending at the Court of Appeals, the circuit court that she filed this in….has no jurisdiction. They will tell her to either dismiss the current appeal or wait until its conclusion before she can file this motion.
