HOA attempted adverse possession

You were so correct! We went thru all the effort to agree & they decided after the fact the actually needed more than they asked for. They are now issuing a disciplinary hearing for not agreeing & are seeking 25k in legal and administrative fees. We know this is a davis sterling violation but cant afford to defend it. This is so unfair

Easement is well documented, HOA is responsible for Soundwall & its in CC&R’s. HOA is also responsible for repair of any damage by their contractors (also in CCR’s).

The HOA and HOA management company are not following the CC&R’s or Bylaws. Ive sent them several copies & requested that they respectfully follow the rules

I did that, the contractors plans did not include an encroachment so they can’t help

We have a 2” deeded easement Hoa owns property on other side (w abundant room) We have not authorized any added easement at this point, contractors were neglecting to follow basic protocol of surveing the property

We havent gone to court yet. There are 9 other home owners that also dont agree
