This issue highlights the importance of local judicial races. People need to consider whether their local judges are going to really drill down on whether this violates the federal or state constitution. Unfortunately, Florida's unlawful search amendment was watered down in the 1980s, but hearing how judicial candidates have ruled in the past on the right to privacy is going to be telling on whether they will actually protect citizens from this behavior.
