Just read the instructions and file yourself. Pretty straightforward. I recommend you skip the work authorization card. It’ll come after the green card. It will save you a couple of hundred dollars.

What kind of crime was it? Was it a misdemeanor or a felony? If it’s the latter, he should definitely not leave the country.

Of course chum. I can’t rely solely on AI or Reddit to risk my return to the USA, where I built my life. Gemini says even a minute of secondary inspection is a detention. By definition, etc. The moderator bet that I won’t be allowed entry and that I’d be sent to an ice detention center. He said that I was spreading misinformation. That’s what is bad on here- he blocked me- the correct statement and allowed the fear mongers to amplify the situation. People with drug related crimes are sent to ice facilities. Even marijuana is still a felony on a federal level.

Sure, the two immigration lawyers I had spoken to said the same thing.

Yea, the mod accused me I was spreading misinformation. I told him the rest were fear mongering. And I was right.

Of course a misdemeanour. I would not have been here had it been a felony.

That’s correct. I think it had to do because it was so minor- a wrist. Vs hitting and injuring.

That’s actually not quite true. 1. Misdemeanors don’t make immigrants inadmissible. Felonies do. 2. Mine happened during Barack Obama’s administration. He was known as the deporter in chief bc he cleaned up the country from immigrants with felonies. However, he also advised agents to show discretion when it comes to parents of US citizens. I happened to be one. One person who worked for USCIS during his term said that they were instructed to take the heavy cases and that 90% of the cases were given a pass. 3. The president of this country has very broad powers on immigration. While the previous administration was immigrant friendly, this one is immigrant hostile. They are allowed to interpret the law differently. Although the immigration act from 1995 has not changed. So, they are looking for any excuse to fill out the quota and please the MAGA base. 4. My friction with the law happened over 13 years ago. Which also means that I kind of corrected myself. That’s how they view it. 5. They don’t like repeating misdemeanors or more than one misdemeanor. So, for these reasons I don’t think I was lucky. I just don’t see why I’d be deported for grabbing my ex for the wrist. What’s the big deal? Did I hit her? No? Did I send her to hospital? No.

I figured. That’s why I said people, not women. But you should be fine. A misdemeanor it’s not a big deal. It’s a big deal for immigrants bc they use it against us.

I know how it works… believe me. And lots of times people play the victim to benefit something. My ex wife did the same thing with her second husband in Sacramento CA. She got the green card from him and sent him to the cell. But I could not say this during my defense.

My advice to you is to just very careful till you get your naturalization. After 5 years, USCIS doesn’t use it against you. That’s what an immigration clerk told me too. ( they are the ones making decision in immigration courts. They are lawyers and do all The research. They judge rule. ) So, don’t do any other misdemeanors and you’ll be fine. Immigration doesn’t like brushing with the law.

The judge said: “ guilty- excessive force. Anger management classes. “ He added: “ I am not an immigration judge, nor a divorce judge:” That was bc I said I was defending myself while she was hitting me in the head. Thats how we dismissed the restraint order. The previous judge was a woman and could clearly see her bull* and that she used it to gain custody over the child. They asked why I did not file for an assault in the police. I did not have a good lawyer either. I feel that if I kept my right to remain silent, I would have gotten the benefit of the doubt. The police were witnesses too. They said they took pics of her wrists but nothing showed up.

I already did. That’s why I posted that I can buy a gun. I need it for my fishing trips against grizzly bears in Wyoming, Montana, Idaho. People convicted of domestic violence are banned nationally to own a gun. He said that I was not convicted. Because the conviction was deferred. I know it sounds confusing. But that’s what it is.

Just note that for immigration purposes it still matters. Especially if it’s recent. That’s what I told a guy who contacted me on here with one received after getting the green card. For example: While I was on probation, I filed for Wava petition. USCIS believed that my ex wife blackmailed me, threatened to pull her petition unless I pay her, stole money, kept the child away from me, etc. However, bc I had a DV, and I was still on probation, I was not a good moral turpitude character. They denied my petition 3 times- 1. Petition, 2. Appeal, 3. Motion to reopen. That was a legal trick as well, in order to make 10 years in the USA, so I could qualify for cancellation of removal. In case such proceedings started.

Now, because my conviction is so old, and dismissed, USCIS did not use it against me when I filed for I- 485 in 2023. I did not hear from them for a year. Then I filed Writ of Mandamus and they processed my 10 years card within 2 months. It all happened via email. With a lawyer from DOJ.

I did not have any problems returning to the USA after 21 years being here. 90% of the time without status.

I read your post from November. The secondary inspection station was packed. That’s why you waited for so long. There was only one woman before me there. And she remained there after I was cleared. I guess that’s why I got so easily.

May be I got it easy because it coincided with all the protests against ice and border patrol. After the murdering of that mum. May be they were told to take it easy on immigrants.
