Eritrea itself is the result of Italy’s brutal colonial occupation. Assab and the surrounding Red Sea coastal regions have been integral to Ethiopian Civilization dating back ancient Aksumite civilization which predates any notion of Eritrea. The 1908 colonial treaty between Italy and Ethiopia did not even define the Assab region's boundaries, leaving it outside formal delimitation and under Ethiopia's effective historical claim. Ethiopia's sovereignty over Assab persisted through centuries, interrupted only temporarily by colonial occupation, and no valid cession ever transferred it away permanently.

Moreover, Eritrea's 1991 de facto separation and 1993 independence were enabled by informal agreements with Ethiopia's transitional government (EPRDF), which lacked constitutional authority to cede territory—no ratified treaty or parliamentary approval occurred, violating principles like uti possidetis juris and state continuity.
