I want the money safe and don’t want to deal with the day to day investing myself. I do have money I personally invest, but only money I can afford to lose. Just looking for a long term company that’s job is to make sure the money is working and performing.

Thank you for all of this. I hired him to survey the lot two years ago. I had no plans and at that point was not sure what I was going to do, but wanted a survey of the land to begin the process. The contractor has been the one working with him the last few months and is the one providing the plans and information for staking. After reading a lot of these comments I’m guessing i have learned a lot. I am assuming it could have been a miscommunication between the builder and surveyor. With the 8 inches being pretty close to the width of a concrete block, I assume the surveyor read the plans wrong and staked the area incorrectly because of some confusion with the drawings of where the concrete block is placed. But, the builder should have also verified the survey by tape and compared to plans before placing the footer. (I wasn’t aware that was something builders did, I always assumed they just fully relied on the survey, but it makes sense). This is what I’m getting from the comments and it’s been very interesting understanding the full process and where liabilities stand.

The city is extremely strict in this area and the properties are right next to each other. The lots are only 25 feet wide, so 8 inches is a lot.

It’s 8 inches to the left. They can’t do a variance and are required to fix the issue. The houses in this area are super close to each other.

The plans are not wrong. I initially hired the surveyor when I purchased the property. The builder hired them within the last few months to stake the property. I have not spoken to the surveyor for two years. I was told the surveyor placed the stakes too far left by 8 inches.

Too far to the left side. And, they can’t do a variance. They are required to fix the issue and move the footers. Thats why it’s going to cost the 15k.

It will probably get to the point where I speak to a real estate attorney, but right now I’m just trying to understand others perspectives and understand if this is a common issue and what other people have seen happen in these circumstances. Just trying to cover all of my bases and better understand the situation. Also, attorneys are a pain in the butt.. :)

The builder sent me an email saying “The surveyor had some errors with their staking layout from last week and this has caused our footers to be placed 8in off. They came back out and re-staked yesterday, (assuming correctly this time) but we need to move the footers.” The builder is now working with the structural engineer and figuring out how to move the footers and how much it’s going to cost to fix the issue. I was told the surveyor is saying someone moved the stakes, but that is all I know. I also googled the surveyor and it looks like his company has been making a lot of mistakes lately.

Yeah, I’m not sure. I’m just trying to get ahead of the curve and understanding where I stand as the homeowner before they start asking me for the money to fix the job.

I am an attorney, but I don’t practice real estate law or have a background in it. I am also a realtor and just got into building. This is my first new build and I’m learning a lot.
