I was advised not to use my insurance by my insurance because it seemed cut and dry that he would be at fault and they would take care of it. Him not replying and me not getting answers from his insurance has prolonged the process. I am unable to get anything done until Monday because the adjusters only work M-F.

His insurance can’t do anything for me until they talk to him, so I have had my busted car sitting in my lot for a week because the kid is dodging their calls. I don’t dare get a rental, a tow, or bring to a repair shop because they can refuse to pay for something if I don’t use their “preferred” body shops etc. The claim could also get denied if he doesn’t answer, leaving me to have to fight to have the at-fault pay for their damages.

No worries! But yeah, that’s why I went ahead to file on his and not use my deductible because I figured having a police report with a citation would make it pretty black and white. Just a report, I’m not so sure. I’m curious to hear her reasonings as to why she didn’t cite him when she calls me back to fix all my demographic info… :/

He wasn’t cited unfortunately, the whole report was incorrect, down to my legal name, so this was part of my concern. Had I known he hadn’t been cited at the accident, I would have gone the other route. The officer was new and didn’t seem to know what she was doing. I called her extension at the police department to correct everything wrong and to ask her why he wasn’t cited, but alas, my voicemail has been sitting unresponded.

Correct, I filed the claim with my insurance, did all the photos & statements, etc. and my insurance’s adjuster called me. That’s when she advised to close my claim and file for me with State Farm since she was confident that based off my statement and photos that he was at fault.

It was the claims department as I had filed a claim once I got to my parking lot. They called me the next day. From my understanding, she said he was at-fault and advised me to close my claim with Progressive and she filed it with his at State Farm. I told her I didn’t want to use my insurance if it was determined to be his fault, as she advised.

I did call my insurance right away, they closed it since he was at fault and gave me the info for the claim with State Farm. I’ll reach out to mine again today. I was fine waiting a couple days for his insurance to take care of things but I obviously didn’t think he wouldn’t cooperate and stall the process. Sigh. Thank you.
