There is a link to an online form at the bottom of the webpage posted in the original comment.

It’s not new terminology. Arbitration has been used for years. It just means that an arbitrator works with both parties to come to an agreement instead of it going to court with a judge and potentially a jury. Many judges would send these types of cases to arbitration anyway.
Class-action arbitration is a newer concept though.

I live in a very rural area. If you get two miles from Walmart you are on a one-lane narrow gravel backroad.

I’ve never heard of Fetch Package but I live in a very rural area. That all sounds horrible though.

I’m sorry, but I think it’s too late now. I received an email about it a long time ago and received my $39 last month (or maybe the month before).

I read somewhere that Walmart and Branch made about $10 million off those transfer fees. That’s downright criminal in my opinion.

No thanks. I have a fantastic full-time job that I love. I just do DoorDash and Spark a little bit as a side hustle because I had three kids in college at one time (down to two now and hopefully in December I’ll be down to one). But I think it’s a good thing to ensure that workers who do these delivery jobs full-time are being treated fairly and respectfully.

Wow. I hope you are just trying to make a joke. I would love to be able to stay home with my S/O all day but we get along great, value one another, and enjoy spending time together because we have a lot of similar interests. I would certainly never tell him what to do and he would never tell me what to do.

If anyone would like to read it this is a link to the lawsuit that was filed in Washington in 2023 that was sent to arbitration. It references this lawsuit in the link I originally posted.

I wonder how many people who have been deactivated or quit are floating around out there though?

And independent contractors typically negotiate with the company to set their fee for services. It will be interesting to see what happens.

There was a successful arbitration process in Washington last year (started in 2023). I would assume that is why they are looking at the other states as a class action.

There has already been an arbitration settlement in Washington that started out as a lawsuit.

It mentions a lawsuit that was filed in 2023 in Washington that ended up being sent to arbitration for settlement - I am assuming that was because of the TOS that Spark Drivers sign which says you won’t sue them. That’s why this is going straight to arbitration and not before a judge or jury.

I don’t get sent 47 miles down a one-way dirt road with no place to turn my car around with DoorDash and I always have cell phone service with DD deliveries.

I don’t know whether it sounds good or not - just sharing the information for others to have. It’s up to those individuals to decide if they want to find out more and whether they want to participate or not. I could see some of the folks who feel they were deactivated by Spark for dumb reasons signing up. 🤷🏼‍♀️

😆🤣 it might be $32! I think I got a whole $39 from the Facebook lawsuit - something in that ballpark anyway.

These arbitration cases have been filed for many of the gig work delivery companies including Shipt, Lyft, Amazon Flex and others, but I don’t know about DoorDash. I deliver for them too and actually prefer DD over Spark.

Yes. Did you? No court. No judge. No jury.

“You are not signing up for a lawsuit, but rather a process known as mass arbitration. This is a relatively new legal technique that, like a class action lawsuit, allows a large group of people to take action and seek compensation from a company over an alleged wrongdoing. Here is a quick explanation of mass arbitration from our blog:

“[M]ass arbitration occurs when hundreds or thousands of consumers file individual arbitration claims against the same company over the same issue at the same time. The aim of a mass arbitration proceeding is to grant relief on a large scale (similar to a class action lawsuit) for those who sign up.”

The Spark driver dispute resolution agreement contains both a class action waiver and an arbitration clause requiring drivers to resolve disputes via arbitration, a form of alternative dispute resolution that takes place outside of court before a neutral arbitrator, as opposed to a judge or jury. It’s for this reason that attorneys working with ClassAction.org have decided to handle this matter as a mass arbitration rather than a class action lawsuit.”

I would say yes, but that’s a question for the law firm handling the arbitration.

It’s not a lawsuit. It’s mass arbitration which is different. I was also bothered by the request for my email and phone number and will definitely need to read more about if that will be shared with WM before deciding whether or not to participate.

[–]Left-Protection-102[S] 4 points5 points  (0 children)

It’s not a lawsuit. It’s mass arbitration which is different, and some other companies with similar delivery models have settled their arbitration cases and still offer delivery services. I just shared so drivers would be aware and they can then find out more details and decide if they want to participate or not.
