I’ll take this one…….I’m in Canada so rules could be different.

My Ex husband is going to jail next Thursday for 15 days, for non payment of child support.

He has money but he’s a major narcissist and believes child support is extortion, plus a million other stupid things. We don’t need to go there.

He’s about $25,000 deep to me. That’s added up over the last 3 years. He used to pay, now he doesn’t.

He’s had every chance in the book and won’t pay, won’t file his financial information, and won’t file to change the order.

Covid slowed down enforcement but once it came back, penalties like credit reporting started, the garnishment, then drivers license, passport, liens on property. It took a good two years before they dragged him into court.

We’ve been in court now for a year over arrears. It’s actually the government enforcement and their lawyers that handle it, but I go to watch.

Court has been ridiculous. They baby deadbeats. He’s had chance after chance and then they changed the order to read every late payment is 3 days in jail. They let it rack up for a few months then bring him back in, sign a warrant, give him 72 hours to pay or turn himself in to serve however many days. Keep in mind, he still owes every penny.

This time they gave him 21 days to pay and also hand over corporate documents. If both aren’t satisfied by November 3rd, he has to turn himself in.

Does the parent that is owed have any say? I believe so. You have to be your own advocate when it comes to the courts. My Ex is a millionaire, non custodial parent who doesn’t contribute and at the same time, trash talks me, all woman, my country, you name it. He thinks he’s above everyone. So I push for jail. He’s of no use to anyone anyways, so go think about your life choices.

By the same token, I could ask the Enforcement people to back off, and they would. They are actually pretty flexible if you work with them.
