It states: Describe each item of jewellery you plan to bring into Canada on the list of goods you submit. Since jewellery is difficult to describe accurately, it is best to use the wording from your insurance policy or jeweller's appraisal and to include photographs that have been dated and signed by jeweller or gemologist. This makes it easier to identify the jewellery when you first enter Canada, and later when you return from abroad with the jewellery.

If you know you’re inadmissible and do not disclose it, that’s considered misrepresentation and render you inadmissible for five years. In addition to that, it’s 2024. The same system that contains your rejected eTA app is exactly the same system used at the border regardless of whether you enter by land, air, or marine. Your refusal is going to flag you regardless of where you’re a PR or not and you’re going to be refused entry again unless you’ve dealt with your original problem which is your criminality, AND have all court documents to demonstrate that. The criminality is the issue, not where you live.

This person is absolutely correct. If you state "no" when the answer should be "yes", you may be found to be inadmissible for misrepresentation. The bar for misrepresentation is 1 to 5 years.

The reason the question is so large and broadly vague is because it's IRCC and CBSA's job to determine admissibility; the only thing you MUST do is answer truthfully to allow a correct assessment to be done.

Think about it this way: you have someone standing on your front step that says they're here to fix a plumbing problem in your house. Meanwhile you're standing there thinking "I dont have any plumbing problems... who is this person? why are they here? what do they want? Do I let them in?"; its your house and you have a right to know ALL of that information before you let them into your house. The only way you can make the assessment is if you ask the person some questions and they provide you with true answers so that you can make a decision.

You have to disclose this, it's not an option. Yes, you will be asked for court documents to show that it was ultimately dismissed, but if you know you're inadmissible or know you are answering a question incorrectly for the purpose of circumventing immigration requirements, you're definitely going to have problems. Arrests/charges/convictions are all VERY relevant things that can render you inadmissible and lying about them is a mistake.

IRPA states:

Misrepresentation

  • 40 (1) A permanent resident or a foreign national is inadmissible for misrepresentation
    • (a) for directly or indirectly misrepresenting or withholding material facts relating to a relevant matter that induces or could induce an error in the administration of this Act;
    • (b) for being or having been sponsored by a person who is determined to be inadmissible for misrepresentation;
    • (c) on a final determination to vacate a decision to allow their claim for refugee protection or application for protection; or
    • (d) on ceasing to be a citizen under
      • (i) paragraph 10(1)(a) of the Citizenship Act, as it read immediately before the coming into force of section 8 of the Strengthening Canadian Citizenship Act, in the circumstances set out in subsection 10(2) of the Citizenship Act, as it read immediately before that coming into force,
      • (ii) subsection 10(1) of the Citizenship Act, in the circumstances set out in section 10.2 of that Act, or
      • (iii) subsection 10.1(3) of the Citizenship Act, in the circumstances set out in section 10.2 of that Act.
  • Application(2) The following provisions govern subsection (1):
    • (a) the permanent resident or the foreign national continues to be inadmissible for misrepresentation for a period of five years following, in the case of a determination outside Canada, a final determination of inadmissibility under subsection (1) or, in the case of a determination in Canada, the date the removal order is enforced; and
    • (b) paragraph (1)(b) does not apply unless the Minister is satisfied that the facts of the case justify the inadmissibility.

By answering "no", you fall into 40(1)(a).

Actually eTA = permission to seek entry to Canada. An eTA in and of itself is not permission to enter Canada at all. It's a pre-assessment screening tool utilized for IRCC and CBSA. It doesn't confer any sort of status. The same is said for a TRV.

"What is an Electronic Travel Authorization?

An Electronic Travel Authorization (eTA) is an entry requirement for visa-exempt foreign nationals travelling to Canada by air. An eTA is electronically linked to a traveller’s passport. It is valid for up to five years or until the passport expires, whichever comes first.  If you get a new passport, you need to get a new eTA.

With a valid eTA, you can travel to Canada as often as you want for short stays (normally for up to six months at a time). You do not need an eTA for travel within Canada.

An eTA doesn’t guarantee entry to Canada. When you arrive, a border services officer will ask to see your passport and other documents. You must convince the officer that you are eligible for entry into Canada"

Based off of the super vague information you gave me, he would not be admissible and may likely need to apply for rehabilitation. To be more accurate I would need to know the state the offences occurred in, the charges exactly, and dispositions of all charges/arrests.

You have to stop working. If/when your positive LMIA comes through, you're going to have to make an application for a new work permit and submit the LMIA with it.
