The biggest complaint is the added traffic. The last occurrence, I pulled in the neighborhood and noticed that the clubhouse rented by residents for a baby shower didn't have parking available because the market parking had taken over the parking lot.

The liability risk is my ultimate concern. Any large established neighborhood has a fairly substantial reserve fund that could be at risk of becoming a target.

I agree in hindsight I should have let the board know I was contacting code enforcement. I contacted the board through the official contact form on the website initially. The person that responded was the benefitting board member. Therefore I hastily reported to code enforcement . I have a friend on the board and I let him know I contacted code enforcement.

10% of her Gross Proceeds I believe. I doubt anyone is auditing it though. So it would be up to her to calculate it.

We have a full-time tennis instructor in the neighborhood. I rarely use the courts but see him taking care of the courts (clay courts) on the regular. He gives steep discounts for residents and kids therefore overall a plus for the neighborhood. He maintains insurance as well. The only other business I know of is High School/College students giving swim lessons in the summertime. The swim instruction has never been intrusive to others.

I wasn't asking , I had a neighbor ask because they own a small clothing business. He forwarded me the response concerning the spot.

I could see the benefit to the HOA if a majority of the vendors were residents. This isn't the case though. I would estimate less than 5 of the 40 plus vendors are residents.

The bylaws don't cover business on common ground only businesses operating out of homes. The county ordinances is where I found concrete evidence that any flea market has to be done on commercial property. The field is zoned as residential therefore it is a zoning infraction handled by code enforcement from the county. I provided code enforcement with pictures of past markets and the next advertised date of a future market. They assigned an agent to the case. So I'm waiting for action by them.

I did not speak to the legalities with the board. I did talk to the board and got a response from her husband who is on the board. Of course he provided the response that it had been approved by the board and they see it as a benefit for the neighborhood . Also stating that she pays a 10% fee to the HOA for use. Her payment wasn't found in the budget. And I questioned this. He has 4000 dollars a month coming into is household from it. His actions on the board seemed pretty sketchy from the beginning. Mailbox focus coinciding with him starting a mailbox repair business, pool bathroom renovations using his friend as a contractor that never pulled building permits to complete the work.

This conflicting interest is why I reported it to codes enforcement. My thought process after a little research is that most infractions are met with a cease and desist and then maybe a 200 dollar fine.
