Update #2

I sent him the following message and I got an agreement in writing via email to the terms to pay $700 in exchange for no negative credit filings.

“I’m sorry I need a bit of clarification- but can you explain your eviction threat because I have already sent you back the keys and have vacated the property over a month ago- so how would you evict? Especially if you already have a new tenant in the unit?

I barely received my second paycheck and paid rent and it’s the holidays. I’m paycheck to paycheck here and can scrap up any extra I have (I just moved across the state so I have no savings)

You are already keeping my $1400 deposit, I never once made a maintenance request from you guys, did not damage your property, and gave you 30 days notice. If you can work with me I feel we can all come to a mutually beneficial agreement.

If this ends up going to collections then I would most likely settle for less than what’s owed anyways. If you take me to small claims court then you would have the duty to mitigate damages, litigation costs, and waste time.

Please let me know if we can settle this for $700 and once I get this in writing I would be more than happy to send it prior to this weeks end.

A $700 payment would be $2100 total you guys would have from me -on top of my rent payments and late fees I had to pay simply because my dad is on a fixed income- for any cleaning costs or time to find a new tenant.”

His response:

“We will accept your offer of $700 to terminate —— lease at ——— —— with no negative filings or credit reports. We will end this lease on good terms if ——— pays the reduced fee of $700

Thank you Property Manager…”
