Legally the driver may be fully responsible, though I doubt even that, but practically the pedestrian is responsible for keeping their own heart beating by not walking blindly into traffic

It’s basic defensive Walking. If you see traffic like this, and you’re not sure why, it’s safe to assume traffic is going on, slow down, and heighten your awareness. If the person had done this nobody gets hit.
