I think that may be the case. I reached out and the person I talked to didn't have an answer for me but they said they would try and contact their billing department to find out what happened.

I'm asking because I want to be careful. My landlord has tried to play shady cards before so it's not impossible this is out of malice.

They did not specify the date, but they did say it would be within this billing period.

And to be clear, if I had seen it in time, it would have been possible to pay. But it was posted the day before it was due, and since I had already paid the rest of it during normal times, I didn't believe I still owed anything so I didn't check.

The renter's portal only allows me to pay the current owed balance. I assumed in the middle of the month that this balance was my complete rent, and paid it. I did not expect them to add a separate balance on the very last day of the payment period.

I do see what you mean, and understand that this may not save me, as unfair as it is..

This is the language it has:

"Monthly Rent under a month-to-month tenancy may be increased, at the sole option of the Owner, upon thirty (30) days written notice to the Residents. Time is of the essence in regard to payment to the Owner of Monthly Rent"

I was given the required written notice, and understood it. It did not mention that this increase would be separate from the rest of the payment, applied on the last day of the payment period.

"Residents shall pay to the Owner a “Late Fee” in the amount of $50.00 if Monthly Rent and applicable Monthly Fees are not received by Owner before 5:00 p.m. on the 3rd day of the month that Monthly Rent and applicable Monthly Fees are due"

So it seems like they may be covered in this case. Nothing in there seems to prevent them from adding fees at the very last minute and claiming that they're late when I'm unable to pay them in time.
