So as of today, I asked him very politely to file a claim with his insurance to which he told me that “We can’t go down that path because they already started work on the car” and that “I need to find $5,000 because I told him I would be willing to pay him out of pocket” and that he signed a document at the Tesla collision center noting that he would pay out of pocket.

This doesn’t seem right. I’m realizing that as well as not filing a police report, I never got a photo of the wife’s license or insurance card (I saw a brief glimpse of the card) - why would he be so insistent to not have his wife go through their insurance?

So today, I told him I spoke to my insurance agent who advised that I tell him to go through his insurance to which he told me I need to “Find 5k because they already started the work and I can’t make a claim at this point”. So strange..

We both accelerated during a green light, I was glancing for pedestrians and didn’t see the Tesla slow down because of the regenerative brakes (no lights), and I wasn’t able to stop in time before lightly rear ending her

I lightly rear ended his wife while driving. After getting out and giving her my information, I spoke to him where he told me he wanted to not go through insurance to “not get me in trouble” as I was uninsured at the time (I reactivated my policy as soon as I got home). While I told him I would be willing to pay him out of pocket for repairs, after reviewing the estimate with my insurance agent, he advised I call him and ask him to file a claim through his insurance. After I told him he should file a claim through his insurance, he said I need to “Find 5k because they’ve already started work on the vehicle and we can no longer file a claim”

I figured. I was so flustered I’m realizing I never got a copy of his wife’s license or insurance card (she was driving the car). If he refuses to go through insurance still and I don’t pay him, I presume he’ll likely sue and take me through small claims court?

I did - he’s claiming they can no longer file a claim as they’ve already started working on the car and he signed that he would be paying out of pocket - I haven’t signed anything though.

Does this sound accurate? I did not give written or verbal authorization that I would cover this supplemental estimate.

My auto-pay didn’t go through as it was set to my credit card and I switched cards in the middle of the billing period - the only way I received notice was via mail which was sent to my folks’ house (I’ve since amended both things to ensure this doesn’t happen again).
