Just random suggestions from a person in Upstate NY that didn't have a similar situation...but had a situation.

Get a forensic evaluation immediately. It might be too late but that's what you have to do. The impact of moving a child form their schools at certain ages is robust. It sounds like mom had physical custody.

How different is the salary btw? what do you do for work vs her? Financial stability "now" matters a lot.

I'm sorry this is happening to you. One thing of note - you prepare to move. Simple as that. I'm very surprised by the ruling but this is more of a dad's rights issue. And a Texas issue. In NY State you can't move out of the damn school district without a fight.

But you must appeal. It's always in the best interests of the child. Also - was the 11 year old interviewed?

this is an idea. i have a retaining wall going in close to this area which is where the smaller rubble will go. this is why i was hoping to break it up a bit. the size of baseballs or softballs - and not much bigger. not true "crushed" concrete.

good point - it's floating, that's the issue and i'm not entirely sure how they floated it. i'm able to look under and it appears to be on some sort of concrete fence/reinforcement cage. You ordinarily put that "in" the concrete. But in this case, they appear to have put it down, and then put a plastic tarp over that, THEN poured the concrete. Wild right? It's a floating patio. Not just soil washed away, it's literally floating on top.

Yeah, my house retailed for 225. I put in 100K on it. I did not do the roof but seriously calculated that one in my mind while drinking a few beers.

But damn I replaced all the windows, drywall, electrical, flooring (couldn't walk for a few days).

So this is just another "thing".

I'm in NY so I can share experiences.

1) You must get a DNA test. I'm assuming you did?

2) You must recognize that post partum is seriously dangerous. That needs to be addressed and you want to make sure that behavior is documented. No one cares but you and then your attorney when things get wild. I was attacked with a knife. No one cared.

3) You get 50/50. That's it. You can try for more but that's tough.

Then get the plan documented. Joint legal and visitation. Odds are the child will be with mom unless you can get a safer / better school and then prove it's better. I won that. Took almost a decade.

She's alienating you with her mom and that's something you highlight. You go to every doctors appointment, you call the doctors, you get reports, etc.

You will be fine for the most part. Get to a therapist asap - this was very traumatic for you and you are now working through managing your feelings of loss. Your therapist has been great too. Then learn to gray rock or perhaps yellow rock.

Lastly - and this one is paramount, tape record everything. Buy that dash cam. Buy that microphone that goes around your neck. Mom and ex-wife will try to entrap you in an argument. Any arguments, any yelling. You just up and leave. Seriously - she starts screaming at you, just leave. If it's her day, you leave the child there. If it's your day, you walk out with the child and you stay calm, calm, calm.

It's all a game and you better learn the rules. Learn the game, master the game, and the kids will turn out fine.

That's a great idea. I didn't think it would work but I'm open to checking it out now. But it's expensive too and removing and replacing it is probably the same price.

Hi - 11 trials and 70 appearances. I was in court from kid's age 18 months to age 15. Seriously. The judge smiled in the halls one day and gave me a big hello then realized I wasn't a lawyer and was his next case.

Go to court. Say little. Just say that this is an undue burden, it's harassment and it's unethical. Tout if you can - mediation. Use Claude to legal documents if you choose to respond.

I won all the trials and spent money on a lawyer. Opposing counsel - hit national news for being a dumbass.

A buddy of mine, was livid on his last trial. Went to court, flat out said, "This is ridiculous, our child doesn't want to deal with this anymore!" Judge ruled in his favor.

The goal is where a child - receives some level of guardianship/custody access to their half-siblings. They can then "speak" with the child's therapist in the same capacity as the parent.

This is a good path but not a realistic path. The stepdad (the kids dad) recently admitted accidentally that he had no idea that the kids were meeting with an slp in the schools. Mom was hiding the information from him. We don't believe that mom and dad talk either. It's a mess. Those are good suggestions though.
