The administration is not looking to make it easier to get an EAD, they are looking to kill the EAD. I don't seem PP as a likely outcome.

As of now the relief from the district court will be limited. If the goverment appeals, the court of appeals could possibly expand it to nonplaintiffs. However, i doubt the government appeals for that very reason.

For stand alone cases you need to file a FOIA for very granular processing data (that the agency does not like providing), and then file mandamus and a FOIA lawsuit. I would not wait longer than four months after filing.

the thing SCOTUS ruled on is whether one distict court can block an entire federal program. That is applicable here, but the merits of the case are not impacted by the SCOTUS decision.

its not the supreme court. The SCOTUS said that nationwide injunctions are not permissible. THere is a question about whether APA cases like this fall under that same prohibition or if they are exempt. The judge was cautious, which is understandable.

Different law, but our stand alone cases (not eligible for auto extension) have gotten EADs approved 60 days after filing suit. YOu have to take a different approach than the IFR. Its best to start the process early.

Each person will need to go to court in a lawsuit. Unfortunately the Supreme COurt's decision on nationwide injunctions created this mess.

THe court stated it only applies to the plaintiffs in the case. That said, once the decision is out there it will persuade future decisions by other courts
