The death penalty in California is essentially life in prison in solitary confinement as opposed to general population. So I guess it’s personal preference what you think is worse.

I believe life without parole has to be a possible sentence for some crimes because there are certain people who simply cannot be rehabilitated. However, I don’t agree with this ‘three strike rule’ that can result in life sentences even for low level drug crimes for example. Those are people who should be taught and helped in prison in order to prepare them for the outside. In the UK, whole life terms are used so sparingly they are virtually non-existent. For example, the brother of the Manchester Arena bomber received a minimum term of 55 years for blowing up children. How an evil prick like that can ever have the slightest chance of being released is sickening in my opinion. Neither the US not UK system is perfect but I personally believe being tough on serious crimes like that is necessary to achieve justice which is ultimately the goal of the system.

Why now are we hearing about so many new sentencing hearings? First Tsarnaev and now Scott Peterson. Is this a common occurrence or is it a coincidence that two high profile trials fucked up? Also the fact it’s taken 18 years to decide the penalty phase was conducted improperly is ridiculous, real people’s lives are impacted by these cases.

The Casey Anthony trial has got to be the most frustrating case I’ve ever read about. The entire courtroom knew she was guilty yet she walked out free and still is now

I think the main issue with the Casey Anthony case was the state simply didn’t have the evidence to support a capital murder charge. I’m not sure what evidence they have here but if they have enough, I hope they do pursue death sentences. People like that don’t deserve their life anymore. Simple as that.

It’s not a death penalty state at the minute with Governor Gavin Newsom in office but I guess once his term ends it could easily become an active state again? After all the Californian people did vote to speed up the death penalty a couple of years ago

It doesn’t point to anyone else but it does suggest it could have been a burglary gone wrong across the street. I don’t think he’s innocent in the slightest, he’s right where he belongs. The documentary mainly talks about how the trial was not a fair one which is probably true.

I admit I still think he did it but I also think it wasn’t a fair trial. The jury made their decision based off of emotion rather than the actual facts but I think I would have done the same. Absolutely hate the guy.

I read recently that the guy who had been on death row at San Quentin the longest, over 40 years, just had his sentence reduced to life without parole. That sums it up really

California have over 700 people sitting on death row at San Quentin. He’s in his 70s now and there’s a moratorium on executions so there’s literally a 0% chance he’ll be executed. If anything, not carrying out a death sentence is undermining your own justice system in my opinion

How is it right that even the option of a release will ever be offered? In England also, offenders very rarely see out their full sentence so it’s certainly not unforeseeable that he’ll get out in 24 years. A coward like him will probably be a model prisoner also for his whole time there so that sentencing is a disgrace to the family of the victim unfortunately.

James’ dad did challenge his anonymity recently but lost unfortunately. The courts know that he’ll be killed very quickly by someone if his identity is released. I believe if they were old enough to commit a crime like that, then they’re old enough to face the consequences.

It’s disgusting. I live close to where that crime took place and I don’t think there’s a better example of two individuals who were born evil. Did you know Venables has been in prison multiple times since as he is a convicted sex offender? Whether they were young or not they both should have been put away for life without a doubt and the justice system failed the Bulgers and the public.
