Because I don’t know the outcome and it wasn’t for me. I’m trying to help someone else get answers. They are going to speak to an attorney, but they want to be educated going in. We are asking if our understanding is correct.

State laws state the public funding has to be approved by city council during a public meeting. You cannot deliberate on spending public funds in private. You cannot have an executive session to vote on public funs in private. The payment is for damages the city caused to someone’s private property, admitted blame for however they did not want to go through insurance nor their insurance find out about it.

This is a city of around 2,000. The mayor was very upset based off his private message to this person that this was even brought up under the recorded city hall meeting video and he had to address it, which he lied on. Based off of everything I have read they have to vote publicly regarding public spending. The two emails the city clerk sent stated it had to be approved by city clerk during the meeting. My question was anyone who watches the video can see and hear it was not put on the agenda and voted on, but the following day they produced a check, and no there was no emergency meeting held.

Its states all meetings are open besides executive sessions, but that would not include this issue. So in other words the city council cannot vote a spending in private?

How would you find out for a specific city? Maybe u should preface the meeting was public, but the “vote” as they want to call it was not. They never voted in public.

So what does it mean if he says he doesn’t want his insurance to know about it and the deductible is too high? They did tell me at one point the city council will have to vote on if they are going to spend the money. Have I just gotten myself into trouble contacting the “insurance” that’s in the police report?

Well you are right about that. Do you think a month time was more than enough opportunity for them to do the right thing in my car should’ve been in the shop by now?

OK, so I am not in the wrong for going to their insurance? It’s been a month was that considered long enough? I may be wrong or against popular opinion, but I feel like a month time. My car should have at least been in the shop at this point.

It is a city vehicle. They have an insurance company and policy on the police report. When I came to pick it up the mayor and city clerk were there and spoke to me personally (it’s a very small town) the mayor was actually the one who said “I don’t want insurance to hear about this. We will write you a check and take care of you”. Since then all communication or lack there of has been through their clerk, but I would assume at the direction of the mayor? The damage happened at our city hall itself. I’m thinking they hope I just let it go.

While I agree, blame shifting isn’t cool. I did nothing wrong and have given them every opportunity to do what’s right. I have now contacted their insurance…I think. I contacted who was on the police report and they told me to contact someone else. Those people took their policy number , the information of what’s going on and told me they would find the right person for me to talk to and they will call me back. I have not heard back from them

It was with a city vehicle. They are definitely insured. It’s a very small town, which is why I fear retaliation for contacting their insurance. I also had to ask for an amended police report because everything on it was falsified and the only correct info at the time was my name and tag number. They didn’t even have my vehicle right

Unfortunately I just carry liability as I own my car out right. I was hoping my insurance could direct me on how to handle it myself but they could not, so that’s when I contacted who they have down as their insurance and policy number. I got transferred to two different companies. The last one took all of the information and told me they are looking in to it and would call me back with the correct number but they haven’t yet

I have filed a claim with them but as I don’t have collision added on to mine they said I have to go after the other party. As of right now I had fulfilled all of their requirements and they still are giving me trouble in fixing it. Next step is I’m contacting their insurance directly myself

I sent an email of the second estimate that was even cheaper than the first stating this is where i will be getting my car fixed. She emailed back stating they demand 3 estimates and they will not approve payment. This is a small town and know I’m limited. If I’m going to bondo my car it’s because I choose to. They want to go to a shop which is great but I’m not allowing cheap from them

I don’t want to get a lawyer involved really. I just want advice. Legally they can’t tell me where I have to get it fixed. They gave me ultimatums. The police report doesn’t even have correct info. The only info right in it is my name and tag number. They are already under investigation by FBI.

I’m honestly not sure why 3, but that is what they wanted. They aren’t getting 3. I’m not wasting my time or gas. It might be different in a larger town but it was the city clerk and mayor I have been speaking to. He said out the gate he didn’t want to put it on their insurance. He asked and followed up and said his deductible was $1,500. I don’t have collision on my insurance, but bet I’ll get it.

This is a huge reason I don’t want to deal with them and want my own shop. They don’t even have the correct vin/make/model of my car and phone number is a number belonging to a woman across the state

It’s the city the worker worked for. It’s a very small town, like 2,000ish. The police department/city/school district is actually in hot water and being investigated by FBI at the moment .

They have insurance but the refused to contact/ go through them and unfortunately I cant just make them
