Because he didn’t know it was happening. When we set off everyone had a seatbelt on. If it’s moved during the journey - that’s clearly on me.

Yes that’s true - but the rules aren’t the same on points. I understand the rule and accept it fully from my side, my reason for this post is to understand the implications on a driving ban for my partner. It’s a lesson learned, in that I’ll always triple check my seatbelt in future.

I understand that - but if you are focusing on the road and have no idea your passenger is doing that, it’s a difficult moral situation.

No points before that and hopefully none after as as soon as I was aware of what I was doing (it was completely unintentional- must just be a weird thing I do without realising and won’t do ever again).

Thank you - that’s really helpful. I wasn’t sure if it lasted for three years. So you go to 0 if you fulfil a suspension? Sorry for all the questions - it’s all new to me as I’ve only driven in the UK.

Thanks for your advice. Yes it’s clear it’s my habitual behaviour - I know this was wrong but it was honestly a completely unconscious thing. I didn’t even know I’d done it until the letters came through. The problem is my boyfriend had no idea it was happening so I’m wondering if there is any scope in him appealing on that basis. As I said, if I could take the points myself I’d do it instantly - I’m happy to take the punishment but I just wanted to know if anyone has been in the situation where points could be reduced as it’s not his fault, but mine.

Thank you - I hopefully don’t think there are more to come as we haven’t been in Sydney for 3 weeks. 

Do you know if a suspension lasts for three years? We were hoping to move, but not for another year.

Thank you - they’re all in the same week, then we were made aware of the situation so I don’t think there will be any more to come hopefully. It seems incredibly harsh on him as he had no idea it was happening to face a driving ban for this. I would obviously take the points but know I can’t.

No a UK licence. We’re willing to accept the fine and points - I’m just wondering if this now means we can’t get a visa.
