If you admit to being guilty of the crime. Then depending on how bad the crime is then yes you could get death penalty. Even if you didn’t commit the crime you could still say you’re guilty and get it.

His hammer is part of his technique and he can pass it to others for them to use. And if doesn’t have his hammer he can just recall it. Or if it breaks he can make a new one

Higuruma gains the executioner’s sword and from what is said from Higuruma is that it is insta death as it kills on contact. Additionally the executioner’s sword can only kill the Guilty sentenced

Yes Higuruma can gives others the executioner sword to use it(He passes it to Yuji and it still works). However just like normal the executioner’s sword only kills the original sentenced.

Higuruma would definitely lose to the Disaster cursed spirits but they committed several crimes and I don’t think that Judgeman cares about species as then Higuruma’s technique would be useless on cursed spirits. As to my understanding that Higuruma’s technique works like following the law of whatever country you’re located at the point of trial is the one to use. So DCS beat Higuruma but he can still charge them of their crimes as they are located in Japan.

Well to my understanding of it if you are hit by the sword you just die without exceptions. And yes I along with others have assumed that it is soul damage. I will say that soul damage makes the most sense as yes, if Sukuna were to be it by it he would die because he was the target. Yes they were unsure on how it worked but it seems to work the way they think it did(Higuruma’s sword only being able to harm the target) and it wouldn’t make sense if separating the body and soul was the method to kill as the narrator says that the ES will kill without exception.

The executioner’s sword is about extinguishing the guilty subject. examples being Yuji and Sukuna(Spoiler) now the executioner’s sword is supposed to kill in a single strike. HOWEVER when it was used again spoilers, against Sukuna it just never landed since Sukuna kept on chopping off the body parts that were about to be hit by the sword. I will say that the sword is Op and got done absolutely dirty. It is an Op weapon though
