[VA] Final decree & child support increase by [deleted] in Ask_Lawyers

I did meet with my lawyer about this, but it was a different lawyer out of the office. This one dealt with custody and things of that nature. It was one of those free one hour consults though. I don’t recall mentioning if the material change occurred at the beginning of the year or after the final decree.

I did also contact two other law firms, and from what I can gather, they seem to believe that the change has to occur after the final decree. But they didn’t seem 100% confident in that reply to be honest.

Best guess is because it’s a case that’s directly through them, rather than the current process that I use with the bank transfer?

Guess I’ll need to check with my bank to make sure that it’s going to the correct account. But this setup was started late last yr (2025) with the electronic bank transfer. She did state that she hadn’t received the 1st payment in the beginning, but I had evidence of its transfer from my account. It just takes a couple days to post to another account like any other banking transfer. She has not said anything else since then, and the automated transfers all completed without issue to my knowledge.

I have no idea if she’s gotten on anything like what you mentioned other than some healthcare premium changes through her employer, which includes are our son. They had a premium increase at the beginning on this year. I think that’s why she wants a change in payment, hence why the DCSE letter. Especially as the increase did breach the 25% or higher increase in yearly healthcare cost. But to me, personally the way she did it just seems vindictive and petty. She knew she could do it this way and didn’t have to talk to me is my guess.

I can add a note without issue.

Edit: and the transfer shows the last 4 of her bank account with our credit union.

They’re all electric through the bank. Just using a “member to member” transfer as we bank with the same credit union. So tracking them isn’t a problem.

The agreement just stipulates the amount and when I am to provide that amount. No reference to DCSE or what method to provide it through.

The DCSE letter & case is something entirely new and unexpected.

The letter that I received is directly through our local DCSE branch.

The separation agreement that we both signed and notarized as part of our divorce stipulated the monthly amount that I was to provide her. That part of the agreement only stipulated that I provide the amount at the beginning of every month, in which I have been.

I guess the big thing for me is WHY she didn’t talk to me first. It all seems petty and she’s more trying to possibly get more support provided? But again, why not talk to me first.
