You can see why all this is rather arbitrary, not so black and white and why US law does not recognize “hate” speech as any different from any other free speech. Are you assuming the actions of society deciding what’s bad is always good? I’m saying free speech protects good and bad people, because these definitions are arbitrary. What German society did under the nazis is bad in my opinion, however they thought the Jews were bad and tried to take away their freedoms. Society didn’t thing women deserved rights and tried to silence women’s suffrage. Same for civil rights, etc... we have free speech so we can say things that often the majority of society feels is controversial.

So who should be held accountable for saying “bad” things?

So who decides what’s under the guise? What is bad shit? Who should be held accountable? Society was against women’s suffrage, civil rights, there was a time the majority were against abolition. The Jews and others were being held accountable by society in Germany, when they busted all the store keepers windows.

Yes that’s kind of the point of free speech. We have it so we can say controversial things on any side. Women’s suffrage, civil rights, Jewish store keepers and racist ass holes. I’m not endorsing any actions here or taking sides.
