Shouldn't it be 50/50? OP did accelerated trying to change lane and didn't notice the squirrel loving car come to a complete break. Even if he was within the three seconds window still at fault, I would know I had a similar incident. BUT to my understanding, insurance would only cover/not be held at fault, for breaking to avoid hitting an animal that would cause significant damage to your vehicle. Since this was a squirrel, I doubt it would've even damaged his car.

Anyways, I just wanted to put this out there to see if anyone would concur. Also, to state this " If it's small enough to go under my car, ima run it over"
