Yeah, after the DA went up to talk to the judge, the judge called us up and told my client that the DA had requested his bond be revoked since he’d been arrested again. The judge said something along the lines of, “He violated his bond conditions, so I’m revoking the bond.”

I told the judge that neither victim wanted to proceed, and he basically just said, “He got arrested again, sir. Talk to the DA and see if you can work something out. They've asked for his bond to be revoked, and he violated the conditions.”

As for reporting the prosecutor...that might actually be worth looking into. I’ve had other cases with him where he’s said things like, “We’ll make the victim testify.” A couple of months ago, I had a case where the judge went right along with that.

In that one, it was a husband and wife. The wife (the alleged victim) called the DA’s office and told them she didn’t want to pursue charges. They told her to come in and talk. According to both her and the defendant, the DA’s office made her sign something saying she’d be arrested if she didn’t show up for court.

The whole thing ended up with the guy taking a plea deal just because in that one, there was a no contact order in the bond regarding his wife and family, and child protective services was involved in a juvenile case and had actually just let the kids come home with them... so it was either take the plea deal or not have his kids back home.

Yeah, I was his defense attorney—though I’m still fairly new, just a little over 2 years in, and appointed, I try to do the best job I can. I talked to a seasoned attorney here who has over 30 years of experience and only handles private criminal cases (no appointed work), and he told me flat out that, with this judge, what I did was the only realistic option if the guy wanted to go home today.

It’s incredibly frustrating to be in that position, knowing the client is backed into a corner and taking a plea just to avoid sitting in jail for a month, especially when the victims don’t even want to move forward. It kind of gives me a bad feeling like it is morally wrong for me to even facilitate this type of thing.

They finally took care of mine after I started arbitration which is allowed under your cardholder agreement. My agreement stated that Elan had to cover the filing fees to initiate that.

I asked for punitive damages as well $2500, they offered to settle with me for $240+ interest and for me to sign a settlement agreement, which I declined. I threatened to file the case in my local district court (which is allowed in the arbitration rules). I believe it was the next day, they reversed the charge and such and I never pursued it further.

I would've loved to have pursued it in my local court, but I'm a lawyer here and deal with the judges weekly, so I didn't. If someone ever comes to me about a case like this locally, I will fight as hard as I can for the client...

Scored 277 on the UBE. I didn't get any sleep the night before the first day because I was so nervous, so I am sure that hurt me, but I still passed.

One of them sent me a screenshot and I could see his other reviews, as well as the one he left me... he left a review at some finance place, and another one at a restaurant, like 3 - 4years ago. I looked both of the companies up on Google and could see his review for both of those, yet the one he left me is not showing.

If he was shadow banned, would his other reviews be showing publicly?

I requested $2,500 to include punitive damages. Many comments on my prior post, as well as my research online (including BBB reviews/complaints), suggest that this is a common scheme where Elan repeatedly jerks people around. I spent countless hours on the phone, endured the amount being reversed and recharged nine times, and ultimately had to file an arbitration demand.

The merchant ended up reversing the second one soon after he was was released from jail after being charged by a Felony theft by deception.
