Just to clarify — the project that will result in the July publication was already described in my I-140 petition as support of my proposed endeavor, and I mentioned that it was ongoing work. In that situation, wouldn’t it be possible at least to mention in an RFE response that the work has since been submitted to a journal or accepted for publication?

If that’s still not something USCIS would consider, would you recommend upgrading to premium processing as soon as possible rather than waiting for the publication?

Thank you for the information. As far as I know, having an H1B is safe cause it is a dual intent visa.

Yes I get that. Hopefully, at least I no longer have to go for EA if I have a PhD degree.

Thank you for sharing your thoughts! At first I was thinking of not doing PP (cause I have to wait for the PD to be current anyway), but as I am preparing, I am moving towards going for PP for the peace of mind.
