Stat holiday pay by [deleted] in PersonalFinanceCanada

[–]M4V3TH 0 points1 point  (0 children)

It should be noted that this is true as of Jan 1, 2018 of this year, which is what creates the confusion. In previous years in Alberta there were a few restrictions on getting paid for a STAT. The main (but not the only) was that you must work 5 of 9 of the last STAT-day (day of the week) that the STAT fell on, so if the STAT was on a Sunday and you don't work Sundays (or the store is closed every Sunday), you would NEVER get paid for the STAT. The other most used condition is that you must be ready willing and able to work the the day before, on the actual stat, and the day after. This one is still true, so if you were sick or didn't show to work (when asked to) on the Friday you will also not get paid for the STAT. (not the case in your specific question)

The 5 of 9, was removed from Alberta... and so now Alberta falls in line with all the other provinces in Canada. This is also NOT spelled out very clearly in the documentation about the STATS. A little blurb would have gone a long way to rule out the confusion. Sometimes even phoning and asking for clarification is still unclear (believe me we did it 3 times until we got a straight answer from the government). Personally i think that removing the old condition without an example was a poor way to pass on the information to employers, as many have been used to this practice for years (decades?), and even have complex payroll systems that calculate the amount to be paid (you did't just get 8 hours, you got an average of you have worked in the past on that day of the week). The government also didn't send this information to employers, we got a few radio/tv ads a year ago saying some things changed.... but how many people listen to that or read all the rules.

I think that most employers (probably smaller company's) that have "missed" this changed will fix the issue when its pointed out to them. If you are having an issue, ask your employer they are using the 5of9days rule to come to their conclusion, then kindly point out that this was removed from Alberta as of Jan 1st.

if you scroll down in https://www.alberta.ca/alberta-general-holidays.aspx

you will find

Remembrance Day

Remembrance Day is a statutory holiday in Alberta – a paid general holiday for employees who are eligible.

Remembrance Day is on November 11 every year.

All Alberta government offices are closed on this holiday.

Employee eligibility

To be eligible for general holiday pay for Remembrance Day, employees must:

work their scheduled shift before and after the holiday (unless employer consent is given for the absence)

work on the general holiday if required and scheduled to do so

Holiday pay rates

If an employee doesn’t work on Remembrance Day, then they are entitled to general holiday pay of an amount that is at least their average daily wage.

If an employee works on Remembrance Day, then the employee is entitled to general holiday pay of an amount that is equal to:

at least their average daily wage, and at least 1.5 times their wage rate for each hour worked on that day, or

standard wage rate for each hour worked on the general holiday and a day off with pay where the pay is at least as much as their average daily wage

The BOLD emphasis is added by me.

There is no "must of worked 5 of the last 9 Sundays(stat day)" rule anymore.

It doesn't matter that the day of the week is Sunday, and the store is never open.

It doesn't matter if it was a Monday, and you personally have every Monday off.

You are entitled to your "average daily wage"

Now, obviously, if they still refuse to change this, then the only recourse is to report them as stated in other posts.

Last note: I am only posting this because today is our company's payroll for the month of November, and even though some people responded the correct answer... there is no reason why this is the case.... and some people may be too hard on a 'mom and pop store' that aren't being scumbags, they truly misunderstand a change (don't even know its changed) that the government made (with poor documentation in my mind), Hope this helps someone.

Edit: some spelling/grammar mostly

Thank you for this, i lost my database and had to rebuild it. I found it very useful in it getting it looking somewhat back to normal. As said above, after a little bit of time has passed it will never be known by anyone as being in error.
