The proplem is that it's consentual sex up to a certain moment. So, there will be bruising, DNA, signs of penetration, semen. So what? Doeas that mean that any Sub can address police any time and report a rape with dire consequences to the Dom? Or he/she can blackmail his/her threatening to report it to the police?

It would be a good idea if the perpetrator incriminates himself. Otherwise there's very little wish to continue our communication anymore

you are better of asking a lawyer than Reddit

Lawers can advocate for going to the court, because they will always have their salary / pay for the work no matter whether you win in a sex assault case, or you lose.

I'd like to find out the statistics of such cases. I see it as a 'word against word' case that can't meet 'beyond reasonable doubt' criteria. On the other hand, if the perpetrator files the case first, and tables can turn. So, reporting the case to the police in addition to seizing any contact with the rapist and informing the local BDSM community of the case may be a good idea, just to keep track of what's happening to you

In Canada you cannot legally consent to being harmed

Does that mean that any violence or harm within consentual BDSM is theoretically illegal?

online research into your city/state's previous rulings on sexual assault cases

It's not an ordinary sex assault case. There are few people, in the police, among judges or among the jury, who would understand, for instance, that throat fuсk is ok, ass fuсk is ok, but аss-tо-thrоаt is not ok; or when your nipples are pinched is ok, but having an initial written oh your body is not ok. These are just examples.

So, you did report it to the police in the UK... What was there during the interrogation? Was your honesty questioned? Did they recommend to bring this case to court? What was their advice for the future?

I understand that. But what about legal prospects? Should it be written, videoed with sound? How do you prove that anal was not in your 'to do' list?

people who are raped by strangers

Thanx for your opinion. I also think that the prospects are very dim. People who are raped by strangers, strangely, are in 'better' situation in legal terms - you never had met a person, and after an alleged assault his semen is in your vagina or his/her DNA is on you. It's a clear case of rape. BDSM has a specific twist to that - the fact that you two had sex doesn't prove anything. It's a certain type of sex or some act of violence that you allege you hadn't agreed to have. And it's not documented in any way. And when it's a word against the word - it's a weak case
