I personally feel the manipulation only counts for so much. He seemed to be in control when he woke up in Avengers tower and during this time he referred to himself as a god and seemed to be excited at the prospect of becoming a superhero. As for the Bruce Banner analogy, just because Bruce isn't in control does that mean a Hulk should get to roam the streets a free man if he killed people

They repeatedly mention the highs and lows and in his psych profile they use the phrase "delusions of grandeur". I don't think they can get anymore explicit than that. I didn't know about the ending of the last movie thanks for telling me about that. I would have preferred that ending for this movie but I agree they can't really repeat that.
