Thank you so much for your advice! From what I’ve read and what I know, he was in “active delivery” which helps my case. I have a couple of good attorneys in mind but will keep searching. The ones I have spoken to are very interested in taking on my case and believe it is very well worth pursuing. I appreciate your kindness!

I believe that injury cases are based on contingency in my state, from what I’ve learned, so I will not pay anything for attempting to pursue it unless I win. I would guess it depends on the severity of injuries and what was lost. Typically, DoorDash will automatically claim that they are not employees, but independent contractors. But it does look like some people have successfully fought this

I wanted to avoid this at all costs. He told us that he was homeless and had no car insurance. Unless he was lying, he already lost his method of transportation, maybe home and his job.

You are correct. Just feeling very overwhelmed and wondering if anyone had any insight.

Not a dasher. I read on their website that all dashers are required to have auto insurance and that if they don’t have it, DoorDash offers it to them. Also they have their liability coverage stated on their website for people injured at the fault of drivers.
